This position is part of the National Archives and Records Administration (NARA). This position is assigned to the Office of Equal Employment Opportunity Programs (NEEO). The EEO Programs office is assigned directly to the Office of the Archivist with the responsibility of providing leadership, direction, and guidance to carry out NARA's EEO Program.
Duties
As an Equal Employment Manager, you will:
- Write final agency decisions and orders that are clear, concise, persuasive and legally sound, and which set forth the facts of the matter and interpret and apply applicable laws and regulations and legal precedent. Decisions are based on a comprehensive analysis and evaluation of the record, including Investigative, Administrative and Hearing files. Cases are often difficult and complex in nature. Analyze and evaluate case materials to establish the facts and circumstances surrounding the complaint. If necessary, initiate further investigations to obtain data needed to clarify or establish the facts and issues involved. Apply legal principles and analytical methods to facts and issues, in determining whether the complainant was discriminated against because of race, color, religion, sex (including sexual identity), disability, age, national origin, sexual orientation, protected genetic information, parental status, or reprisal.
- Review all class action discrimination complaints filed with the Treasury Department. Analyze complaints to determine the issues involved in class certification and acceptance of the complaint. Prepare the correspondence to transmit the complaint file to the Equal Employment Opportunity Commission (EEOC) for assignment of an Administrative Judge (AJ). Upon receipt of the AJ's decision on certification non-certification, in conjunction with the agency representative and the Director, OCRE, determine whether to implement or appeal the certification non-certification determination made by the AJ. Develop and prepare written correspondence which outlines facts and issues supporting the OCRE determination on class complaints. Coordinate with and provide technical advice to the bureau counsel serving as the agency's representative to resolve problems that arise.
- Based on the nature of the findings on individual and class complaints, the incumbent recommends appropriate corrective action such as promotion, back pay, compensatory damages, or changes in organizational policies, procedures or practices. In areas such as compensatory damages, where few precedents exist, may have to research federal and private sector insurance case law in an attempt to determine appropriate award recommendations. These decisions may give rise to considerable public interest and may engender social and political reactions.
Qualifications
You must meet the following requirements within 30 days of the closing date of this announcement.
SPECIALIZED EXPERIENCE: For the GS-14, you must have one year of specialized experience at a level of difficulty and responsibility equivalent to the GS-13 grade level in the Federal service.
Specialized Experience for this position includes:
Reviewing reports of investigations and preparing legally sufficient final decisions based on federal regulations, laws, and policies; AND
Preparing reports and briefing supervisors, management and staff on a variety of Equal Employment Opportunity (EEO) and/or Merit Systems Protection Board (MSPB) issues; AND
Recommending solutions to problems or conflicting issues impacting EEO.
In addition to the above requirements, you must meet the following time-in-grade requirement, if applicable (as defined in 5 CFR 300, Subpart F):
For the GS-14, you must have been at the GS-13level for 52 weeks.
