The Fair Employment Practices Specialist (Equal Employment) position is located in the Office of the Deputy Director, Office of Fair Employment Practices (OFEP). The OFEP prevents, identifies, and remedies prohibited discrimination, unfair practices, and related wrongful conduct within the AO through its Fair Employment Practices Complaint Process; and promotes, encourages, and expands diversity, inclusiveness, equal employment opportunity, and fairness in the AO and the judiciary.
Duties
This position will report to the Fair Employment Practices Compliant Program Manager in the Office of Fair Employment Practices (OFEP). The OFEP is seeking a self-motivated professional Fair Employment Practices Specialist (Equal Employment) to join its team. You will be part of a dedicated support team striving to enable the achievement of the constitutional and statutory mission goal of the judicial branch of government - to provide equal justice under law. The incumbent will provide counseling and investigative support for the OFEP involving discrimination complaints and other unresolved disputes. The incumbent will be planning and conducting independent investigations of Equal Employment Opportunity (EEO) discrimination complaints and other unresolved dispute cases filed by employees. These complaints involve issues related to all areas of human resources to include staffing, position classification, and employee relations, employee development, and compensation, as well as denial of reasonable accommodation, hostile work environment, and harassment claims.
The duties of this position include, but are not limited to:
Conducting constructive counseling interviews and reviewing pertinent documents to gather and analyze facts about alleged claims of discrimination.
Conducting settlement negotiations and Alternative Dispute Resolution conferences in an effort to resolve complaints of discrimination.
Providing technical guidance and assistance to complainants, managers, and FEP investigators regarding FEP complaint matters.
Planning and conducting independent investigations of discrimination complaints, and other unresolved dispute cases filed by AO employees.
Obtaining documentary evidence and sworn testimony through personal face-to-face interviews, fact-finding conferences, telephone or video conference interviews, and interrogatories.
Assisting in the development and delivery of classroom and computer-based FEP complaint process and Diversity, Equity, Inclusion & Accessibility (DEIA) training.
Researching relevant case law and regulations to provide responses to routine FEP matters.
Developing and maintaining appropriate statistical data regarding the discrimination complaint process.
Conducting analysis of trends regarding demographic data and FEP complaint trends.
Responding to routine inquiries from complainants and responding management officials and assists with preparing various reports.
Ensuring training materials are routinely updated to reflect any changes in the law and AO policy.
Assisting in the planning, development, and execution of various OFEP initiatives and events.
Qualifications
Applicants must have demonstrated experience as listed below. This requirement is according to the AO Classification, Compensation, and Recruitment Systems which include interpretive guidance and reference to the OPM Operating Manual for Qualification Standards for General Schedule Positions.
Specialized Experience: Applicants must have at least one full year (52 weeks) of specialized experience which is in or directly related to the line of work of this position. Specialized experience must demonstrate experience in ALL areas defined below:
Utilizing federal regulations, legal precedent, and agency policy to develop, implement, and monitor agency EEO programs and to report agency status to management officials;
Conducting independent constructive counseling interviews and reviewing pertinent documents to gather and analyze and report facts about alleged claims of discrimination;
Providing support to complaint, managers, and investigators to ensure the timely processing of EEO complaints;
Providing notice of rights, responsibilities, technical guidance and assistance to complainants, managers, and investigators regarding complaint matters;
Researching and reviewing industry best practices pertinent federal decisions and guidance to assess the overall effectiveness of an agency's EEO program; and
Applying knowledge and understanding of Alternative Dispute Resolution techniques to resolve workplace disputes.
