Incumbents perform complex technical and professional work that supports the Appeals Council's programmatic and adjudication responsibilities.
Duties
Assists the Appeals Council to ensure proper application and interpretation of the provisions of titles II, VIII, and XVI of the Act and disposition of cases coming before the Appeals Council.
Performs an in-depth review of the facts of the case; researches legal aspects of the case as necessary; analyzes the legal sufficiency of the ALJ's decision or dismissal;
(cont'd) identifies complex and difficult issues in the interpretation of, or application of court rulings, legislation, regulations and agency decisions and opinions to arrive at technically sufficient and legally sound conclusions,
(cont'd) and presents such conclusions in writing to the Appeals Council, ensuring that the analysis or recommendation includes appropriate reference to statutes, regulations, and Social Security Rulings.
Reviews and drafts proposed Appeals Council actions and recommendations for disposition of the most complex cases, such as those involving significant policy, legal or precedent-setting issues.
May be called upon to provide technical staff assistance to the Appeals Council in cases involving appearances by claimants and their representatives before the Appeals Council;
(cont'd) as needed, prepares a case analysis for the appearance, attends the appearance and participates in any post appearance discussions.
Identifies cases, which may be published as Social Security Rulings; prepares a written case summary and gives legal programmatic assistance, offers research in appearances before the Appeals Council in which arguments about program law occur.
On a sampling or other basis, performs in-depth quality review audits of case files at the hearings, appeals, and civil actions adjudication levels.

- Fingerprinting and background and/or security investigation may be required

- Selectees may be required to serve a 1 year probationary period.
- Relocation expenses will not be paid.
Qualifications
Applicants must have 52 weeks of specialized experience at the GS-12 level, or equivalent, which is in or related to the work of the position to be filled and has equipped applicant with the particular knowledge, skills, and abilities to successfully perform the duties of the position. Such experience includes reviewing and analyzing highly complex and technical administrative and/or judicial appeals from claims arising under Titles II, XI, XVI, and/or XVIII of the Social Security Act, as amended, in order to arrive at technically sufficient and legally sound conclusions.
