This position is located in the Office of the Consolidated Adjudicatory Boards (the Boards) which are independent quasi-judicial bodies with jurisdiction to hear and decide appeals from decisions from the lower administrative bodies within the Department of Labor.
This position is inside the bargaining unit.
Duties
GS-0950-09
This developmental position, located in the Office of the Office of the Consolidated Adjudicatory boards, Washington, DC, composes a career ladder structure to the full performance level of Paralegal Specialist, GS-0950-11. The primary purpose of this position is to perform a legal support and facilitate the proper distribution of cases for the Benefits Review Board (BRB).
The incumbent will complete assignments, projects, and any other on-the-job training activities, including courses or classroom training (as assigned by the supervisor) which develop skills or knowledge needed to progress to the next higher grade level. Promotion to the next higher grade is not guaranteed and is dependent on demonstration of 1) successful performance, 2) successful completion of training, 3) determination by the supervisor that the employee is capable of performing at the next higher grade-level in the career ladder, and 4) the needs of the Agency.

Examines case records and docket files. Determines legal and procedural points at issue, the action sought by the claimant, the type of appropriate response, governing authorities, possible dispositions, and potential ramifications of each case. Assigns a level of priority to each case. Certifies contents of case records, upon appeal to district or appellate court. Assists in the classifying, reviewing, and assigning of appeals.
Prepares and processes motions and orders. Determines the suitability and adequacy of motions. Oversees communication with claimants or agencies that need assistance with providing adequate or timely documentation. Directs improperly filed motions and orders to the correct legal body, or
returns them to the claimant with recommendations for correct submission.
Researches, analyzes, and determines appropriate actions on claims and motions. Applies case law and drafts sections of Board decisions in pro forma cases. Analyzes claims, including petitions for reconsideration and attorney fee requests and motions. Summarizes Board decisions and orders for distribution to attorneys. Makes determinations of the acceptability of claims, and materials in support of those claims.
Drafts responses to Congressional, Freedom of Information Act (FOIA), and similar inquiries.
Updates and maintains automated case management and evidentiary systems. Downloads case records and assists claimants and government staff in the effective use of docketing and related software.
Other duties as assigned.
Requirements
- Must be at least 16 years old.
- Must be a U.S. Citizen.
- Candidate required to obtain the necessary security/investigation level.
- Requires a probationary period if the requirement has not been met.
Qualifications
You must meet the Basic Requirements listed in the Education Requirements section and the Specialized Experience to qualify for Paralegal Specialist, as described below.
For GS-0950-09: Applicants must have 52 weeks of specialized experience equivalent to at least the next lower grade level GS-07 in the Federal Service.
Qualifying specialized experience for GS-09 includes experience providing legal support that should include analyzing case documentation; researching factual and legal issues; and assisting in the preparation of motions, orders, and other legal actions.

master's or equivalent graduate degree
or
2 full years of progressively higher-level graduate education leading to such a degree.

LL.B. or J.D., if related
For GS-0950-11: Applicants must have 52 weeks of specialized experience equivalent to at least the next lower grade level, GS-09 in the Federal Service.Specialized Experience is the experience that equipped the applicant with the particular knowledge, skills, and abilities (KSA's) to perform the duties of the position successfully, and that is typically in or related to the position to be filled. To be creditable, specialized experience must have been equivalent to at least the next lower grade level.
Qualifying specialized experience for GS-11 includes experience providing legal support that should include independently analyzing case documentation; researching factual and legal issues; and assisting in the preparation of motions, orders, and other legal actions.
