Duty Location to be based in Detroit, MI or Milwaukee, WI. Pay to be set based on the locality pay area of the Duty Location. This is an appointment under the DOL Recent Graduates program. The program duration is one year. Upon successful completion of the program and at the agency's discretion, the appointee may be converted to a term or permanent position in the competitive service. The entire duration of the Recent Graduate Appointment constitutes a trial period.

Duties

This position is located in Office of Labor-Management Standards (OLMS) Office in Detroit, MI or Milwaukee, WI. The primary duty of this position is the conduct of civil and criminal investigations of individuals and labor organizations that have or may violate provisions of the Labor-Management Reporting and Disclosure Act of 1959 (LMRDA). The incumbent will plan, direct, and conduct compliance and enforcement activities within an assigned geographic area. This is a career ladder progression position; the duties described below are at the full performance level (GS-12). Incumbents hired at or below the GS-9 grade level will serve in a developmental capacity, wherein the work is less complex in nature and the supervisor, or a senior level employee provides specific instruction and guidance. At the GS-12 grade level, the incumbent will perform the following: Plans, conducts, and completes complex civil investigations, compliance audits, supervised elections, and, as assigned, complex criminal investigations under the Labor-Management Reporting and Disclosure Act of 1959 (LMRDA) and other related laws as directed by the Office Director or other appropriate Office of Labor-Management Standards (OLMS) management officials or as requested by United States Attorneys and State Prosecutors. Develops investigative plans and coordinates additional investigations, integrating findings and conclusions into a comprehensive report. Prepares comprehensive, well-documented, sign-off quality reports of investigative findings, and recommends appropriate disposition. Prepares criminal complaints and draft indictments for United States Attorneys and State Prosecutors. Conducts or participates in meetings with union officers, attorneys, accountants, etc., to negotiate agreements to correct violations and reach settlement. Researches, investigates, analyzes, and examines accounting and financial records and the structure, philosophies, policies, and operating practices of labor organizations; discovers and develops leads; gathers evidence; determines when investigative depositions should be taken; and, when appropriate, requests grand jury and agency subpoenas to secure evidence and develop testimony. Initiates and conducts meetings, discussions, and conferences with parties germane to the investigations such as union officers, union employees, attorneys, accountants, and union members. Explains the LMRDA requirements and OLMS investigative procedures to gain access to records and gather information and evidence. Persuades reluctant or intimidated witnesses and union officers to provide information and to comply with LMRDA requirements, and, as necessary, develops confidential informants. Initiates contacts and maintains liaison with union officials, representatives of the Solicitor of Labor, and, as assignments dictate, with United States Attorneys and State Prosecutors, and other federal, state, and local law enforcement agencies. Works with the Assistant United States Attorney and legal staff of the Solicitor's Office in preparing cases for criminal prosecution or civil litigation. When appropriate, may testify before Federal or State grand juries and serve as a witness in respective trial courts. Advises the US Attorney or State Prosecutor during the trial concerning investigative findings and/or matters and past practices of the union and Office of Labor-Management Standards. Provides compliance assistance to clientele to achieve and improve compliance with the regulatory and statutory requirements of the LMRDA and related statutes. Work Environment: Initial assignments are typically performed in office settings, but usually require additional on-site investigative work. This on-site work may occur during evening or other irregular hours in workplaces of union officials or other persons at work sites that include unsafe and crime ridden urban areas, factories, union office buildings, constructions building sites, mine operations, trucking terminals, warehouses, etc. and could expose the Investigator to some personal and environmental risks in order to accomplish required mission.

Qualifications

You must meet the listed in the "Education Requirements" and/or the "Specialized Experience" to qualify for Labor Investigator, as described below. To qualify at the GS-05 level: Experience: 3 years of general experience, 1 year of which was equivalent to at least a GS-4 in the Federal service. General experience is progressively responsible experience that demonstrates the ability to analyze problems to identify significant factors, gather pertinent data, and recognize solutions; plan and organize work; and communicate effectively orally and in writing. OR Education: 4-year course of study leading to a bachelor's degree. OR Combination of Education and Experience as described above. The total percentage must equal at least 100% and must be fully supported by your resume and transcripts. FOR THE GS-07 Level: Applicants must have 52 weeks of specialized experience equivalent to at least the next lower grade level GS-05 in the Federal Service, that demonstrates the knowledge, skills, and abilities to perform successfully in the duties of this position. Specialized Experience is the experience that equipped the applicant with the particular knowledge, skills, and abilities (KSA's) to perform the duties of the position successfully, and that is typically in or related to the position to be filled. To be creditable, specialized experience must have been equivalent to at least the next lower grade level. Qualifying specialized experience for GS-07 includes at least three or more of the following: Providing assistance to higher level staff in researching and applying laws and regulations to identify discrepancies; Performing regulatory compliance work; Assisting in the examination of financial data and records to compile data and draw conclusions; Assisting in conducting fact-finding interviews to gather information; Drafting correspondence for final review and signature; and/or Preparing comprehensive, well-documented, sign-off quality reports. OR Education: One (1) full academic year of graduate level education; OR Combination of Education and Specialized Experience: applicable education and experience as defined above. The total percentage must equal at least 100%. This must be fully supported by your resume and transcripts. OR Superior academic achievement (S.A.A.). S.A.A recognizes college or university students who have successfully completed all of the requirements for a bachelor's degree and achieved superior academic standing as evidenced by one of the three methods described below. S.A.A. is based on (1) class standing, (2) grade-point average, or (3) honor society membership. Class standing -- Applicants must be in the upper third of the graduating class in the college, university, or major subdivision, such as the College of Liberal Arts or the School of Business Administration, based on completed courses. Grade-point average (G.P.A.) -- Applicants must have a grade-point average of a. 3.0 or higher out of a possible 4.0 ("B" or better) as recorded on their official transcript, or as computed based on 4years of education, or as computed based on courses completed during the final 2 years of the curriculum; orb. 3.5 or higher out of a possible 4.0 ("B+" or better) based on the average of the required courses completed in the major field or the required courses in the major field completed during the final 2 years of the curriculum. OR Combination of Education and Specialized Experience: applicable graduate education and experience as defined above. To be eligible for an appointment, you must meet requirements A. or B.

A. Completed all requirements for an associate, bachelor, master, professional, doctorate, vocational, or technical degree or certificate from a qualifying educational institution within the previous two years;

or

B. Was released or discharged from active duty within the previous two years, where the applicant is a veteran who, due to a military service obligation, was precluded from applying for a recent graduate position during any portion of the two-year eligibility period following completion of his/her degree or certificate requirements, provided that not more than six years have transpired since the applicant completed the requirements for a degree or certification. You must submit an academic transcript from your academic institution showing the date that you most recently completed the academic requirements described above.
