About the Position: This position is with HQDA, Office of the Army General Counsel, The Deputy General Counsel Acquisition team. Excepted Service Attorney Term Positions: This position is term not to exceed 3 years. It is temporary but may be extended.

Duties

Advise Army officials concerning a variety of legal issues associated with assigned defense acquisition programs and general procurement or fiscal law and policy matters. Perform research, and prepares legal opinions, usually final, that address pertinent legal and policy authorities and advise upon a recommended course of action to resolve such issues. Review and, as required, negotiate inter-agency and international agreements in support of Army programs. Communicate with senior Army attorneys within the Office of the Judge Advocate General, as well as Army Materiel Command, Corps of Engineers, and other major commands and activities on matters of interest to Headquarters, Department of the Army. Advise leadership on matters relating to assigned defense acquisition and information technology programs under the Army's purview. Participate in HQDA-level review of solicitations and contracts in support of acquisition programs to ensure compliance with statutory and regulatory requirements and policy guidance. Assist the Deputy General Counsel for Acquisition in exercising technical channel supervision of all Army attorneys providing legal advice relating to programs managed within the AAE-PEO-PM structure. Serve as Recorder and Counsel to the Army Contract Adjustment Board (ACAB). Provide oversight of Federal and state court litigation pertaining to Army acquisition programs or Army procurements. Provide legal advice in support of international cooperative research, development, and acquisition programs, as well as foreign military sales and export control matters.

Requirements

• Appointment may be subject to a suitability or fitness determination, as determined by a completed background investigation.

• This position is covered by the Alcohol and Drug Abuse Prevention and Control Program. The incumbent is required to sign a DA Form 5019 and must pass urinalysis testing, as required prior to appointment and periodically thereafter.
• This position requires you to submit a Public Financial Disclosure Report (OGE 278) or a Confidential Financial Disclosure Report (OGE450) upon entry, and annually thereafter.

Qualifications

Who May Apply: US Citizens Applicants will be evaluated to determine if they meet the minimum qualification requirements and on the extent to which their application shows possession of the following knowledge, skills and abilities (KSAs) associated with the position. KSA's: 1) Knowledge of and experience as a legal adviser in the areas of: defense research and development, acquisition, and logistics programs; federal procurement (including non-procurement instruments and other transactions); information management; information technology; cyber, defense business systems; and general principles of administrative and fiscal law. 2) Experience advising on administrative and federal court litigation in connection with source selections and post-award contract disputes. 3) Experience advising senior level civilian and military officials commensurate with the duties and responsibilities of this position. 4) Demonstrated ability to work independently based on overarching supervisor direction and feedback, anticipate and identify potential legal and policy issues, and prepare legal opinions, usually final, that address pertinent legal and policy authorities and advise upon a recommended course of action. VETERANS PREFERENCE INFORMATION: There is no formal rating system for applying veteran's preference to attorney appointments in the excepted service; however, the Department of the Army considers veteran's preference eligibility a positive factor for attorney hiring. TIME-IN-GRADE REQUIREMENTS: If currently employed as an attorney by the Federal Government must have completed 52 weeks at the next lower grade level within 30 days of the closing date of the announcement, or previously served at the same or higher grade as the position being filled. Time-in-grade may be waived for current federal employees at management's discretion. The following minimum qualification requirements must be met before applicants are eligible for further consideration. Education: An applicant must have successfully completed a full course of study in a school of law accredited by the American Bar Association (ABA) and have the first professional law degree (LLB or JD). Bar membership: Applicant must currently be an active member in good standing of the bar of a state dated within three months of the date the application is submitted, territory of the United States, District of Columbia, or Commonwealth of Puerto Rico. Fitness to practice law. A sworn (notarized) statement from you that your fitness to practice law or conduct as an attorney has never been challenged in any jurisdiction to the best of your knowledge, or if either has been challenged, a sworn (notarized) statement concerning the facts and circumstances, together with any explanation that you deem appropriate may be submitted. As an alternative to a sworn (notarized) statement, a statement which includes a declaration under penalty of perjury may be submitted in the following format: "I declare (or certify, verify, or state) under penalty of perjury under the laws of the United States of America that the foregoing is true and correct...executed on (date)... (your signature)." (28 U.S.C. 1746). The statement must be dated within three months of the date the application is submitted. The statement is required to be submitted by all applicants to include attorneys currently appointed to positions under the qualifying authority of The Judge Advocate General (including active duty Army Judge Advocates). Experience: Applicant must have five or more years of professional legal experience, acquired after being admitted to the bar, commensurate with the duties and responsibilities of the position.
