About the Position: In this position you will serve the as primary contact for advisory legal services concerning Contracts. Description of the working environment: Work is performed in an office setting. Description of Location: The District Office is located in the heart of beautiful downtown Nashville, TN, the home of country music. It is just a three block walk to the historic Ryman Auditorium and Music Row.

Duties

Responsible for activities pertaining to contract formation affecting the award of contracts, including review of Invitations for bid, Requests for Proposal, and source selection documents. Represents the District in agency bid protests, and at the Governmental Accountability Office with full responsibility for presenting the Government's case. Provides legal advice on all phases of contract performance and administration - contract interpretation, modifications, terminations, contract closeouts, architect-engineer liability, warranties, latent defects, etc. Manages and administers the procurement fraud prevention program by investigating, researching, analyzing, opining, and disposing or recommending disposition of cases. In the area of fiscal law, responds to/advises on alleged Anti-deficiency Act violations, project funding issues, and District purchase/expenditure issues. Conducting legal research and analysis on sensitive matters.

Qualifications

Who May Apply: US Citizens In order to qualify, you must meet the education and specialized experience requirements described below. Experience refers to paid and unpaid experience, including volunteer work done through National Service programs (e.g., Peace Corps, AmeriCorps) and other organizations (e.g., professional; philanthropic; religious; spiritual; community; student; social). You will receive credit for all qualifying experience, including volunteer experience. Your resume must clearly describe your relevant experience; if qualifying based on education, your transcripts will be required as part of your application. Additional information about transcripts is in this document. The minimum qualification requirements must be met before applicants are eligible for further consideration: Education: In order to qualify for this position, you must have successfully completed a full course of study in a school of law accredited by the American Bar Association (ABA), and have the first professional law degree (LLB or JD). Bar Membership: Applicant must currently be a member in good standing of the bar of a state, territory of the United States, District of Columbia, or Commonwealth of Puerto Rico. Experience: Applicant must have one or more years of professional legal experience, acquired after being admitted to the bar, commensurate with the duties and responsibilities of the position. Graduation from an ABA-Accredited Law School in the top 25% of the class or an advanced law degree such as an LLM may substitute for one year of the required professional legal experience, including the three (3) years of experience required for the GS 13 level. Time Requirements: GS 13: Three (3) or more years of professional legal experience, acquired after being admitted to the bar; commensurate with the duties and responsibilities of this position. The statement "commensurate with the duties and responsibilities of the position" means the hiring authority is specifically seeking candidates with Government procurement experience. If currently employed as an attorney by the Federal Government, you MUST have completed one year at the next lower level within 30 days of the announcement's closing date, or previously served at the same or higher grade as the position being filled. Specialized Experience: In addition to your questionnaire answers, your resume must address any specialized experience you possess in the following areas: (1) Exercising discretion and independent judgment in the application of laws, regulations, precedents, and agency practices, (2) Providing legal advice and representation related to federal acquisition and procurement laws, regulations and policies on actions involving civil works contracts, (3) Furnishing counsel and guidance on procurement matters including issues of law and fact regarding procurement methods, government policies, appropriate legal authorities, types and forms of contracts, and the various consequences of the contract types and terms and conditions under consideration, (4) Providing legal advice and statutory interpretation regarding problems related to a wide range of contracts and procurement questions and issues on complex legal matters pertaining to these activities for applicable mission areas, (5) Preparing cases for trial and/or the trial of cases before a court or administrative body or persons having quasi-judicial authority. Experience includes preparation of responses, obtaining evidence, conducting depositions, preparation of briefs, motions, witness stipulations and other documents, as well as conducting the case before the judge or hearing officer, (6) Ability to function effectively as a counselor and advisor to senior officials and project delivery teams within the Corps of Engineers, and to work with private entities, local and state governments, and other federal agencies, at the highest levels, (7) Identifying, researching, evaluating and analyzing facts and complex legal issues, including regulations, policies and directives such as the Federal Acquisition Regulation (FAR), Comptroller General Decisions, OMB Circulars, Board of Contract Appeals decisions, and applicable Public Laws and case law decisions. You will be evaluated on the basis of your level of competency in the following areas: -Legal, Government and Jurisprudence VETERANS PREFERENCE INFORMATION: There is no formal rating system for applying veteran's preference to attorney appointments in the excepted service; however, the Department of the Army considers veteran's preference eligibility a positive factor for attorney hiring. Applicants eligible for veteran's preference must include that information in their cover letter or resume and attach supporting documents (e.g., DD Form 214, Certificate of Release or Discharge from Active duty) to their submissions. Although the point-preference system is not used, applicants eligible to claim a 10-point preference must submit a Standard Form (SF) 15, Application for 10-Point Veteran Preference, and supporting documentation required for the specific type of preference claimed.
