These positions are located in the Office of the Assistant Secretary for Civil Rights, Center for Civil Rights Enforcement, Employment Adjudication Division (EAD) and Conflict Complaint Division (CCD). The U.S. Department of Agriculture through the Office of the Assistant Secretary for Civil Rights is responsible for ensuring that employment discrimination complaints are investigated fairly, promptly, thoroughly, and in strict compliance with the EEOC regulations and Management Directive110.

Duties

Serves as program evaluator and technical advisor for the agency, monitors, reviews, and evaluates Equal Opportunity (EO) compliance in assisted areas and provides technical assistance as necessary. Requires knowledge of cases in the field of equal opportunity, interpretation of Executive Orders, laws, regulations, etc. Advises management and other specialists in all aspects of case preparation. Prepares guidelines detailing the approach, issues, and strategies involved in program fact-finding for an investigation. Assist in determining when evidence is sufficient and agency positions and case files are complete and works with Departmental Office of Civil Rights to process a case of adjudication. Assists with making recommendations for decisions for strategies when preparing national reports for the Department of Justice and other departments Utilize skill in developing new methods or procedures when handling precedent-setting cases involving large quantities of disputed data, where in-depth analysis is required. Determines appropriate methods of data collection and appropriate formats to present agency accomplishments Prepares comprehensive reports which summarize data for compliance with equal employment opportunity laws for the below: Title VII of Civil Rights Act, Pregnancy Discrim Act, Equal Pay Act of 1963, Age Discrim in Employment Act of 1967, Sec 501/505/508 of the Rehabilitation Act of 1973, Architectural Barriers Act of 1968 and Genetic Info Nondiscrimination Act of 2008

Qualifications

Applicants must meet all qualifications and eligibility requirements by the closing date of the announcement including time-in-grade restrictions and specialized experience as defined below. Time in grade: Current federal employees applying for a promotion opportunity must meet time-in-grade (TIG) requirement of 52 weeks of service at the next lower grade level in the normal line of progression for the position being filled. Applicants must meet the specialized experience and/or education requirements shown below. If qualifying based on experience, your application or resume must clearly show that you possess the specialized experience requirements. Specialized experience is defined as experience that is typically in or related to the work of the position to be filled and has equipped you with the particular knowledge, skills, and abilities to successfully perform the duties of the position. GS-13 One year of specialized experience at or equivalent to the GS-12, or its non-Federal equivalent that includes (1) Writing, interpreting, and analyzing probable facts applicable to law for Final Agency Decisions; (2) Reviewing and analyzing Reports of Investigation (or similar documents) for legal and technical sufficiency; (3) Identifying and articulating issues and basis for adjudication; (4) Maintaining knowledge of legal theories of discrimination and analytical frameworks; and (5) Managing and/or reviewing the drafting or finalization of compliance and non-compliance decisions. This position has a Selective Placement Factor, which is a skill, knowledge, ability for the job's satisfactory performance. The Selective Placement Factor represents the minimum requirements for this position and is a prerequisite for appointment. Applicants who do not meet the Selective Placement Factor are ineligible for further consideration. Selective Placement Factor: Your resume must demonstrate experience analyzing probable facts applicable.to law for Final Agency Decisions. Experience refers to paid and unpaid experience, including volunteer work done through National Service programs (e.g., Peace Corps, AmeriCorps) and other organizations (e.g., professional; philanthropic; religious; spiritual; community, student, social). Volunteer work helps build critical competencies and can provide valuable training and experience that translates directly to paid employment. You will receive credit for all qualifying experience, including volunteer experience.
