The Division provides legal services to the Mine Safety and Health Administration ("MSHA") in MSHA's headquarters in the district and field offices throughout the country, to administer and enforce the Mine Safety and Health Act of 1977, as amended ("Mine Act").
The duty location for this position is in the National Office.
This position is inside the bargaining unit.
Duties
The incumbent will perform a variety of substantive legal assistance duties in support of the professional attorney work in the Division. The incumbent will work on litigation and non-litigation cases and projects for Division's trial, appellate and standards/legal advice sections. The incumbent reports to the Deputy Associate Solicitor and works for program counsels depending on the case or project. As needed, the incumbent will assist attorneys in preparing cases for trial (and may attend and assist in the trial itself), preparing cases for appeal (including reopening cases), preparing rule making activities, and performing other duties in support of the various activities of the trials section, appellate section, and the standards/legal advice section. The incumbent will also perform administrative duties which are necessary in order to support the substantive legal assistance, including data compilation and analysis from SOL and MSHA sources, file and records management activities, and other duties/tasks.
Requirements

- Candidate required to obtain the necessary security/investigation level.
- Requires a probationary period if the requirement has not been met.
Qualifications
If applicable, applicants must meet the eligibility requirements of time-in-grade (52 weeks at the next lower grade), time-after-competitive-appointment (90 days), and minimum qualifications (52 weeks equivalent to the next lower grade in federal service). These requirements must be met within 30 days of the announcement closing date.

You must meet the Basic Requirements listed in the "Specialized Experience" or "Education Requirements" section to qualify for Paralegal Specialist, as described below.
To qualify based on specialized experience, applicants must have 52 weeks of specialized experience equivalent to at least the next lower grade level, in the Federal Service.
For the GS-12, applicants must have 52 weeks of specialized experience equivalent to the GS-11. Examples of specialized experience at the senior/advanced level includes: 1.) Conducting research on routine cases and noting and correcting case file deficiencies. 2.) Analyzing and evaluating case files to identify factual issues, assisting in trial preparation. 3.) Provides effective direct service on assigned matters to include preparing pleadings, and researching and compiling documents.
Specialized Experience is the experience that equipped the applicant with the particular knowledge, skills, and abilities (KSA's) to perform the duties of the position successfully, and that is typically in or related to the position to be filled. To be creditable, specialized experience must be equivalent to at least the next lower grade level.
Qualifying specialized experience is defined as experience that has equipped the applicant with working knowledge of Federal law and regulation governing requests for information under the Freedom of Information Act and Privacy Act. Applicants must have demonstrated this knowledge through education, review and analysis of FOIA practices and procedures.
