The incumbent analyzes Merit Systems Protection Board decisions and arbitration awards for decisions with substantial impact on civil service law, rule or regulation under the jurisdiction of OPM in support of the Director's statutory authority to request reconsideration of erroneous decisions. The incumbent serves as a government-wide policy and technical expert in areas such as adverse actions, performance-based actions and employee relations implications of other Federal personnel policies.

Duties

Provide expert technical advice, support and recommendations on the development and interpretation of Government-wide Employee Relations statutory, regulatory and policy requirements for adverse and performance-based actions. Conduct research on Employee Relations case law, analyze findings and determine the relevance to current procedures and policies. Serve as the lead for analysis of policy and legal implications of proposed changes to existing policies or proposed new policies. Analyze Merit Systems Protection Board (MSPB) decisions, court and selected arbitrator decisions and identify any that have a substantial impact on civil service law, rule or regulation under the jurisdiction of OPM. Provide Employee Relations advice to agencies using knowledge of legal and regulatory requirements, past practice and trends established by MSPB decisions. Provide presentations on Employee Relations topics before large and small groups often addressing complex issues. Assess the effectiveness of current Government-wide Employee Relations and appellate systems policies based on continuous monitoring and review of case law and analysis of studies by parties such as the MSPB and Government Accounting Office (GAO). Compose position papers, talking points, Congressional testimony, regulations, or formal legislative proposals on Employee Relations topics. Lead OPM teams on a variety of assignments and projects relating to development and implementation of Employee Relations policies. Provide guidance to OPM policy offices on Employee Relations implications of proposed changes (legislative and regulatory) in all areas of Human Resources management policy.

Qualifications

For the GS 14: You must have one year of specialized experience comparable in scope and responsibility to the GS-13 grade level in the Federal service (obtained in either the private or public sector) performing ALL of the following tasks: 1) researching and analyzing Employee Relations (ER) case law from various sources (e.g., U.S. Court of Appeals for the Federal Circuit and MSPB); 2) utilizing knowledge and experience with ER policies, consisting of adverse and performance-based actions, and appellate systems sufficient to develop legal interpretations based on legislative history and conflicting case law to address emerging workplace issues; AND 3) providing input on the development of new or revised ER policies by drafting official proposals, regulatory amendments, option papers, or other material appropriate to the nature of the proposals. (Note: Your resume must fully support this experience.) Merit promotion applicants must meet time-in-grade requirement as defined in 5 CFR 300, Subpart F. One year at the GS-13 level is required to meet the time-in-grade requirements for the GS14 level. You must meet all qualification and eligibility requirements within 30 days of the closing date of this announcement. Experience refers to paid and unpaid experience, including volunteer work done through National Service programs (e.g., Peace Corps, AmeriCorps) and other organizations (e.g., professional; philanthropic; religious; spiritual; community, student, social). Volunteer work helps build critical competencies, knowledge, and skills and can provide valuable training and experience that translates directly to paid employment. You will receive credit for all qualifying experience, including volunteer experience.
