This position is located in the Department of Health and Human Services (DHHS), Office of the Secretary (OS), Immediate Office of the Secretary (IOS), Departmental Appeals Board (DAB). The DAB conducts impartial, independent review of disputed decisions under more than sixty (60) statutory provisions and provides legal support to the corps of DAB Administrative Law Judges (ALJs) and Administrative Appeals Judges (AAJs) on the Medicare Appeals Council.

Duties

ABOUT THE POSITION The Secretary has delegated to the Board the authority to issue decisions under more than 60 statutory provisions governing Department programs. The purpose of this position is for the incumbent to serve as the Chair performing duties connected with the DAB. Provide leadership to DAB and its staff, including strategic planning, assessment of objectives and results, management of financial and human resources. Assess the needs of the organization as it evolves and coordinates the development of DAB's operational budget including written justifications for submission to Office of Management and Budget (OMB) and the Congress. Designates Panels of the Board to consider any appeal submitted to the Board and designates themselves or another Board Member to serve as Presiding Board Member.

  • This is a career position in the SES. Unless the selectee is already a member of the SES with career status or has successfully completed an SES Candidate Development Program certified by OPM. ECQ's will be required before appointment.

Qualifications

Open to all groups of qualified individuals from the public. Current employees within the Federal Civil Service. Current Career SES and SES reinstatement eligibles. SESCDP graduates may also apply for noncompetitive consideration. All candidates for SES positions with the Federal Government must demonstrate leadership experience indicative of senior executive level management capability. To meet the minimum qualification requirements for this position, you must show in your resume that you possess the Fundamental Competencies, five Executive Core Qualifications (ECQs), and the Professional Technical Qualifications (PTQ's), listed below. It is recommended that your resume emphasize levels of responsibility, scope and complexity of programs managed, and program accomplishments and results. Typically, experience of this nature will have been gained at or above the equivalent of the GS-15 grade level in the Federal service or its equivalent with state and local government, the private sector, or non-governmental organizations. Failure to meet this basic qualification requirement and all executive and technical qualification factors will automatically exclude you from further consideration. Professional Technical Qualifications (PTQ's): This position also requires that you possess PTQ's that represent knowledge, skills, and abilities essential for success in this role. The following PTQ's must be evident in your resume. Describe experience in examining or applying complex legal principles in which precedents were conflicting or non-existent in order to make determinations and conclusions that guided the organization in resolving subsequent, similar problems; or resulted in the development of positions on legal issues that were precedent setting, had government-wide impact and were binding on other Federal agencies. JD and bar admission required. Experience in developing and implementing organization-wide operations and processes for advising high level organizational officials and external stakeholders on complex and difficult legal questions or factual issues. Experience in formulating, developing, implementing, and revising policies, strategies, and processes in order to provide high-quality adjudication services and maintain efficient and responsive business practices. Applicants must be licensed and authorized to practice law under the laws of a State, the District of Columbia, the Commonwealth of Puerto Rico, or any territorial court established under the United States Constitution. Judicial status is acceptable in lieu of "active" status in States that prohibit sitting judges from maintaining "active" status to practice law. Being in "good standing" is acceptable in lieu of "active" status in States where the licensing authority considers "good standing" as having a current license to practice law.
