This position is located in the Legal Division, Bank Activities and Regional Affairs Section, Supervision, Legislation and Enforcement Branch of the Federal Deposit Insurance Corporation in Washington, D.C.
Salary reflects a pay cap for this position of $300,000.
Duties
Develops and/or assists in the development of directives, procedures, policies, and administrative guidance needed for the efficient operation of the Section. Represents the Deputy General Counsel (and sometimes the General Counsel) in liaison and coordination activities and FDIC matters within and outside the FDIC and the US Government and performs a leadership role in such activities, including in interagency legislative, rulemaking, and other negotiations.
Responsible for providing legal advice relating to open bank supervision; serves as a top bank regulatory expert for the Legal Division. As directed or otherwise necessary, personally oversees a case load consisting of the most difficult, complex, significant, and precedent-setting matters relating to areas of responsibility assigned to the Section. Undertakes special projects and assignments as requested by the FDIC Chairman, General Counsel, or Deputy General Counsel.
Drafts (requires coordinating with other senior FDIC officials and staff) memoranda, comment letters, and talking points for the Chairman and other Board members on legislative matters. Analyzes substantive and technical aspects of legislation affecting the FDIC.
Oversees, coordinates, and serves as a resource for Regional Offices regarding legislative, regulatory, assessments, consumer protection, community reinvestment, and bank supervisory issues. Counsels and advises the Chairman's office and other FDIC officials and staff about pending and enacted legislation and helps to implement newly enacted legislation.
Provides Legal support to the FDIC Chairman (and senior staff in the Office of the Chairman) regarding his or her role as a voting member of the Financial Stability Oversight Counsel (FSOC), interprets the laws and authorities applicable to the FSOC, many of which are novel, complex, and require coordination with senior staff and officials within the FDIC and negotiation with other FSOC member agencies.
Drafts and oversees recommendation memoranda and opinions for the FDIC's Supervision Appeals Review Committee and Assessment Appeals Committee (chaired from time to time either by the FDIC Vice Chairman or other Internal FDIC Board member) based on complex written submissions from appealing depository institutions and their outside counsel.
Ensures that the FDIC's rulemakings comply with applicable laws and internal policies on rulemaking; drafts regulations and comment letters on other agencies' rulemakings. Provides legal counsel on a wide range of deposit insurance and assessments issues and initiatives, including consultations with FDIC officials and staff, members of the public, and outside counsel on complex questions of deposit insurance coverage, brokered deposits, pass through deposit insurance, and depository institution assessments.
Provides legal interpretations concerning golden parachute questions and related issues under applicable statutes, implementing regulations, and other statutes and regulations affecting the FDIC and/or governing the operations, activities and structure of financial institutions.
Responsible for overall leadership/supervisory/managerial responsibilities with respect to all Section functions and personnel, including supervising his/her subordinate Senior Counsels in all aspects of personnel administration, preparing budget and staffing proposals, and reviewing attorney work product to ensure quality, timeliness, and consistency of legal advice rendered and clear and concise written work.

Qualifying experience may be obtained in the private or public sector. Volunteer work helps build critical competencies, knowledge, skills, and abilities can provide valuable training and experience that translates directly to paid employment. MINIMUM QUALIFICATIONS: All applicants must submit a resume that addresses each minimum qualification experience. Leadership Experience 1: Experience in operating through subordinate managers conducting legal services and counsel. Legal experience leading collaborative efforts or assisting in running an organizational unit that involves work of a highly technical (legal) nature that has a major impact on an agency's financial regulatory and supervisory functions.
Technical Experience 1: Experience in leading the preparation of legal memoranda and other legal documents on very complex, sensitive legal issues, including those involving questions of first impression and with strongly conflicting precedents, which require extensive research, analyses, and ingenuity to resolve; AND
Technical Experience 2: Experience in providing authoritative legal advice, oversight, and assistance on legal issues arising out of new legislation impacting FDIC's bank regulatory functions; AND
Technical Experience 3: Experience in leading collaborative efforts on the development or modification of legal policies and/or procedures impacting a significant FDIC or bank regulatory program(s).
Basic Qualification Requirement: License to practice before the highest court of a state, territory, commonwealth, or the District of Columbia and in good standing.
