This position is located in Field Operations Directorate, Office of Field Operations, Investor Program Office (IPO).
As an Adjudication Officer, you will interpret, apply and enforce an intricate field of Immigration and Nationality laws to make determinations on requests for EB-5 applications.
Duties
The responsibilities described are for the full performance level. At developmental grade levels, assignments will be of more limited scope performed with less independence, and limited complexity.
Follow new and established USCIS directives, instructions, regulations, etc. to achieve IPO program objectives within posted USCIS processing times for each USCIS form type.
Use government and commercial systems to perform mandatory background and security checks in accordance with all applicable laws and policies.
Grant or deny complex, highly sensitive, and routine applications and petitions for immigration benefits based on electronic or paper applications/petitions.
Follow the performance standards for accuracy and integrity when performing adjudications and/or providing adjudicative support.
Establish effective working relationships and communicate orally and in writing with internal Department of Homeland Security (DHS) customers and the public.
Qualifications
The qualifications for this position must be met by 11:59 PM (Eastern Time) on 10/18/2024.
Current Federal employees must have served 52 weeks at the lower grade or equivalent grade band in the Federal service. The Time-in-Grade requirement must be met by 11:59 PM (Eastern Time) on 10/18/2024.
GS-12: You qualify at the GS-12 level if you possess one (1) year of specialized experience, which is equivalent to at least the GS-11 level in the federal government, that equipped you with the skills needed to successfully perform the duties of the position. You must have experience performing the following duties:
Analyzing evidence, and applying statutory requirements, regulations, and judicial and administrative precedents;
Making final determinations on difficult and sensitive immigration-related benefits cases that are discretionary, precedent-setting, have high visibility and are of great importance to the agency;
Writing eligibility assessments to support written decisions and/or correspondence related to the deny or approval of an immigration benefit.
GS-13: You qualify at the GS-13 level if you possess one (1) year of specialized experience, which is equivalent to at least the GS-12 level in the federal government, that equipped you with the skills needed to successfully perform the duties of the position. You must have experience performing the following duties:
Making final determinations on immigration eligibility and properly document the basis for the decision in writing assessments, legal decisions, and/or analysis worksheet for sensitive and/or national security casework that have media interest, or interest from other government agencies;
Analyzing the operations or procedures of a program or process and making recommendations for improvements or modifications to the program or process;
Reviewing and providing expert guidance on immigration adjudications to ensure proper application of all relevant guidance.

Education
EDUCATIONAL SUBSTITUTION: There is no educational substitution at these grade levels.
Training: If you have not already done so, you will be required to attend and complete a USCIS Officer training course. This is typically provided through a blended approach of virtual instruction followed by in-residence instruction at a training venue. Training must be successfully completed according to the standards of the agency. Failure to do so will be grounds for mandatory removal from the position. Such failure will result in either reassignment to a different position, demotion or separation by appropriate procedures.
