Qualifications

There is an existing vacancy for an attorney to serve as Assistant Counsel for the Deputy Chief of Naval Operations (DCNO) for Personnel, Manpower and Training/Chief of Naval Personnel (PM&T/CNP), which is part of the Office of Counsel for the Office of the Chief of Naval Operations (OPNAV), located in Washington, DC. OPNAV includes the Chief of Naval Operations, the Vice Chief of Naval Operations, the Director, Navy Staff (DNS), the DCNOs, the Assistant Chiefs of Naval Operations, the Chief of Legislative Affairs, and other members of the Navy, the Marine Corps and civilians assigned or detailed to the office. The DCNO (PM&T/CNP) is responsible for planning and programming all manpower, personnel, training and education resources for the U.S. Navy and its 400,000 personnel, including Navy Recruiting Command, Navy Personnel Command and Naval Education and Training Command. The successful candidate primarily will focus on civilian personnel/labor, ethics and administrative law issues, but will advise on the full range of Department of the Navy (DON) Office of the General Counsel (OGC) practice areas, including administrative investigations, procurement, fiscal law, and ethics. The successful candidate's responsibilities will include interpreting all statutes, Executive Orders, and regulations impacting civilian personnel matters; interpreting and assessing decisions of administrative and federal tribunals such as the Merit Systems Protection Board (MSPB) and the Equal Employment Opportunity Commission (EEOC) on civilian personnel law issues and their possible impacts; representing assigned clients before tribunals such as MSPB and EEOC in matters of litigation or negotiation using alternative dispute resolution procedures, as necessary; and interpreting fiscal law, regulations, and policies as they affect civilian personnel and other matters. The successful candidate must be able to discern when a contemplated action will likely result in a complaint, prohibited personnel practice, claim or other risk to the DON, and render all necessary legal advice. The successful candidate also will help formulate civilian personnel policy and decisions up front to minimize legal risk to the Command. The successful candidate's advice will extend beyond the realm of legal matters into business judgment, management policy, and administrative affairs. Experience refers to paid and unpaid experience, including volunteer work done through National Service programs (e.g., professional, philanthropic, religious, spiritual, community, student, social). Volunteer work helps build critical competencies, knowledge, and skills and can provide valuable training and experience that translates directly to paid employment.
