This position is located in the Federal Trade Commission, Bureau of Competition, Health Care Division. The Commission is a bipartisan federal agency with a unique dual mission to protect consumers and promote competition. The Bureau has law enforcement responsibilities for antitrust charges arising under Sections 2, 3, 7, and 8 of the Clayton Act and under Section 5 of the Federal Trade Commission Act. The Bureau's law enforcement activities affect virtually every segment of the U.S. economy.

Duties

The Assistant Director is a key member of the Bureau's senior management team, and devises and implements program and policy decisions in furtherance of the FTC's competition mission. The AD exercises wide discretion in legal strategy and in long-term planning and directing investigative and litigation proceedings for the purpose of enforcing the statutory provisions discussed above. Serves as the primary link between the Division, other Bureau leaders and FTC commissioners, and maintains contact with a wide range of public, private, and international groups with diverse interests in competition matters. The AD is a key source for FTC's advice on broad questions and Division's policy. Devises and implements Division policy; reviews policy recommendations that affect the Division and Bureau missions; considers political, social, economic, technical, and administrative factors that potentially impact recommended policies; and formally recommends action to the Bureau Director or other approving official. Provides counsel and guidance for legal staff members on policy questions, and matters of legal strategy and reviews legal documents prepared by the staff (e.g., documents relating to proposed enforcement matters, recommendations that cases be closed, trial briefs, motions, proposed findings and orders) for consistency with agency policy, soundness of judgment, and legal sufficiency. The Assistant Director performs or supervises other functions as may be delegated in the light of the Bureau's overall workload requirements. The work performed under the incumbent's supervision generally involves coordinating the most complicated and difficult antitrust investigations and proceedings in both unregulated and partially regulated industries. Legal matters dealt with are characterized by extreme complexity - factual issues, the body of relevant case law and precedent, and other factors. Manages and supervises the activities of the personnel and staff within the Division, ensuring that management techniques and policies are based on sound organization, position management, and federal employment practices. The incumbent performs human resource management functions relative to the staff supervised, including establishing and clearly communicating performance expectations; providing informal and formal feedback to evaluate staff organizational performance; and providing advice and counsel to staff members and subordinate managers related to legal and policy matters. The incumbent is responsible for the training and effective utilization of the legal staff assigned, for evaluating their work product, and for initiating recommendations for promotion and other personnel actions, in conjunction with other Assistant Directors with whom the staff members may also be working. The AD is responsible for furthering the goals of equal employment opportunity by initiating nondiscriminatory practices and affirmative actions for the area under their direction. Professionally and administratively directs, oversees, supervises, coordinates, and reviews the work of 30-40 attorneys and other support staff, who are engaged in such functions as detecting possible violations of the statutes, determining whether alleged or suspected violations warrant investigation, formulating plans and legal theories for investigations which they conduct or are conducted by Commission Regional Offices, providing assistance and guidance to the regional offices in connection with cases tried at the local level, evaluating investigative matters for sufficiency of evidence to support formal legal action and making recommendations whether to bring actions based on these matters, drafting formal complaints containing charges of law violation, preparing briefs for and conducting the prosecution of complaints before federal District Courts or the Commission's Administrative Law Judges, drafting proposed findings of fact, conclusions of law, and cease and desist or divestiture orders for consideration, drafting appeal briefs and presenting oral arguments in cases appealed to the Commission. The incumbent may be called upon to appear before the Commission, Congressional committees, industry regulators, industry representatives, and various forums to discuss the work in the Division, trends in the competitive economy, emerging problems of law violations, proposed legislation and regulation, and other matters. The AD may represent the Commission or the Bureau as a principal liaison before government agencies and other groups and may give speeches and briefings to various groups.

Requirements

  • You must possess a J.D. or LL.B. degree from an accredited law school, and an active Bar membership.
  • Background investigation (Public Trust) is required.
  • You will serve a one-year probationary period unless you have previously completed the probationary period in the Senior Executive Service (SES).
  • The individual selected will be required to file an Executive Branch Personnel Financial Disclosure Report (OGE Form 278) in accordance with the Ethics in Government Act of 1978.
  • This position may be eligible for remote work or telework from a regional office. If selected, you must be approved for remote or telework prior to onboarding in accordance with FTC's Workplace Flexibilities Policy.

Qualifications

QUALIFICATIONS: As a basic requirement, applicants must demonstrate technical and professional competence as described in the Mandatory Professional Credentials/Technical Qualifications section below and executive leadership capabilities as described in the Executive Core Qualifications (ECQs) of the SES listed below. Typically, experiences of this nature will have been gained at or above the GS-15 grade level or its equivalent in federal service, or with state or local government, private industry, or nongovernmental organizations. If you are a current career member of the SES, are eligible for reinstatement into the SES, or have completed an SES Candidate Development Program and have been certified by the Office of Personnel Management's (OPM) Qualifications Review Board (QRB), you can apply for competitive and/or noncompetitive consideration. For competitive consideration, you must submit a resume and written statements addressing the Mandatory Professional Credentials/Technical Qualifications, ECQs, and other applicable qualifications. For noncompetitive consideration, you must submit your resume, written statements addressing the Mandatory Professional Credentials/Technical Qualifications, and other applicable qualifications. Written statements addressing the ECQs are not necessary for noncompetitive consideration. You must also provide documentation of QRB certification (i.e., SF-50 showing career SES status or OPM-issued SES qualification certificate). MANDATORY PROFESSIONAL CREDENTIALS AND TECHNICAL QUALIFICATIONS: Mandatory Professional Credentials: Must possess a J.D. or LL.B. degree from an accredited law school, and active bar membership which permits the practice of law in the United States. Mandatory Technical Qualifications (should not exceed two pages per qualification): MTQ1 - Knowledge and experience in legal areas relevant to the Commission's work, including antitrust law and unfair methods of competition; federal court litigation; and their application to health care products, services, and professionals, including pharmaceutical pricing and reimbursement. MTQ2 - Experience in the management of complex legal issues. Experience includes analyzing complex legal issues and questions of litigation strategy, reviewing pleadings, briefs, and legal memoranda, and providing oral and written legal advice and recommendations. MTQ3 - Ability to analyze economic evidence surrounding antitrust matters and unfair methods of competition. MTQ4 - Demonstrated experience in supervising and/or reviewing the work product of attorneys and other staff in a legal office with a focus on achieving high-quality organizational results. EXECUTIVE CORE QUALIFICATIONS: All applicants must submit written statements describing accomplishments that would satisfy the ECQs. You must respond to all ECQs and address each one separately, as failure to do so will result in a rating of 'ineligible' for the position.
