The position serves as the Division Chief and expert for the EBSA investigation and enforcement programs. The incumbent ensures that, per legal mandates, investigations are recognized, appropriately investigated; and presented to various U.S. attorneys throughout the United States.
This position is Outside the bargaining unit.
Duties
Major duties include but are not limited to:
- The Chief establishes and maintains close and cooperative working relationships with
the agency or department management and officials, government agencies, and other
institutions with related interests to advance the programs and objectives of the Agency.
Continuously monitors and evaluates the program and operations to ensure compliance
in meeting strategic objectives and goals.
- Serve as an advisor to the office Director of Enforcement, Assistant Secretary, and
Deputy Assistant Secretary for Program Operations, regarding the planning,
development, implementation, and evaluation of current and proposed goals, objectives,
and strategies for the EBSA enforcement program.
- Formulate, recommend, and oversee the implementation of the strategies,
methodologies, targeting criteria, procedures, reporting and accountability systems, and
guidance that form the basis for the EBSA enforcement program. The incumbent
provides recommendations on program priorities and resource requirements based on
an in-depth knowledge of statutory requirements, industry needs and problems, and
concerns and objectives of EBSA, the Department, Federal, and State agencies with
which EBSA must coordinate enforcement activities.
- Review and interpret the relevant policies, regulations, and proposed legislation
developed by EBSA and other DOL, Federal, and State agencies. Evaluates the trends
and patterns of investigations and litigation efforts carried out by DOL and other Federal
agencies and analyzes resulting court decisions. Also, reviews cases conducted by
EBSA investigative staff for consideration of possible criminal enforcement action.
Based upon these activities, provides analytical comments and position papers that
address the impact of policy, regulatory, and legislative changes and court decisions on
the EBSA enforcement program.
- Participate with other Departmental, Federal, State, and local agencies to formulate
national strategies, programs, goals, and enforcement efforts. Initiates and maintains
intra-Department, interagency, and intergovernmental liaison to assure coordination of
Department, Federal, State, and local programs aimed at reducing criminal activities
related to employee pension and welfare benefit plans. Develops close and cooperative
working relationships with other Departmental components, other Federal agency senior
and executive staff authorized to investigate and/or prosecute criminal matters, and
State agencies that have authority for prosecution of specific actions within their
respective states.
- Responsible for the technical and administrative supervision of professional, technical,
clerical, and/or administrative work to carry out the mission of the organization.
Determines acceptability, rejection, or correction of contractor work.
- Interview candidates for positions; recommend appointment, promotion, or assignment
for positions; hears or resolves complaints from employees; refers group grievances
and more serious unresolved complaints to a higher level; and effects minor disciplinary
measures. Responsible for ensuring all personnel management actions are following
merit principles and Equal Employment Opportunity (EEO) program guidance.
- Responsible for programming and annual budgeting submissions and ensuring program
accomplishments are within budget allocations. Makes recommendations for budget
adjustments.

Requirements

Qualifications
Applicants must have 1 year of specialized experience equivalent to at least the next lower grade level, GS-14, in the Federal Service.
Specialized experience is experience that is generally in or directly related to the line of work of the position to be filled and which has equipped the applicant with the particular knowledge, skills, and abilities to successfully perform the duties of the position.
Specialized Experience for this position is defined as analyzing legal issues involving laws such as Employee Retirement Income Security Act (ERISA), Health Insurance Portability Accountability Act (HIPAA), Mental Health Parity and Addiction Equity Act of 2008 (MHPAEA) and other similar health laws, polices and regulations; applying civil investigative techniques; and providing technical guidance, reviewing and evaluating ERISA covered health plans and a variety of other health and insurance products and vehicles.
Education
There is no substitution of education for experience at the GS-15 level for this position.
