With more than 500 total employees, more than 400 of which are licensed attorneys, the Office strives to provide sound legal services to fulfill the Department's diverse and wide-ranging mission.

Duties

This position works with the Office of Indigenous Connectivity and Technology (OICT) in the Bureau of Indian Affairs (BIA). OICT is responsible for the promotion of policy development for wireless communications, electromagnetic spectrum, electric vehicles, and other technology on Tribal lands. OICT is responsible for the coordination, planning, and administration of grant programs that support the expansion of broadband, wireless infrastructure, digital communications, including Internet technologies and electromagnetic spectrum, electric vehicles (EV), and technical assistance and other training. This position will interact with the OICT Director, the offices of the Secretary, Chief Information Officer (OCIO), Assistant Secretary for Indian Affairs, and BIA leadership in the development and implementation of policies and programs. At the full performance level, GS-14, this position will provide legal advice and support in the following areas: 1. Using knowledge of and experience in the telecommunications sector, provides analysis of complex tribal jurisdiction issues, including spectrum and broadband deployment and availability on or near Tribal lands, and/or digital equity projects and represents the Department at workshops, conferences and meetings related to division programs, as appropriate. 2. Provides regulatory and legal guidance on the Federal Communications Commission (FCC)'s spectrum licensing and auction authorities, as it applies to Indian lands and Native Hawaiian Homelands. 3. Ensures coordination and implementation of the duties arising from the 2022 Tribal Spectrum Memorandum of Understanding (MOU) between the Interior DOI, FCC, and Department of Commerce NTIA. 4. Reviews and advises on new spectrum opportunities on Tribal lands, including the development of spectrum test beds and opportunistic use of electromagnetic spectrum (EMS) on Tribal lands, including new spectrum economic development opportunities and potential use of spectrum as a tribal asset

Basic Qualification Requirements Applicants must be law school graduates with LL.B. or J.D. degrees AND applicants must be an active member in good standing of a state, territory of the United States, District of Columbia, or Commonwealth of Puerto Rico bar. Applicants must also meet the following: GS-14: In addition to meeting the basic qualification requirements described above, applicants must also have the following additional years of professional legal experience for the grade level indicated: To qualify for a GS-14 applicants must possess at least 4.5-years of professional legal experience following law school graduation. Experience refers to paid and unpaid experience, including volunteer work done through National Service programs (e.g. Peace Corps, AmeriCorps) and other organizations (e.g., professional; philanthropic; religious; spiritual; community; student; social). Volunteer work helps build critical competencies, knowledge, and skills and can provide valuable training and experience that translates directly to paid employment. You will receive credit for all qualifying experience, including volunteer experience. For any of the grades indicated above you can substitute one year of experience with any of the following: have a second professional law degree; OR meet any of the criteria indicated below: academic standing in top one-third of law school graduating class; other equivalent evidence of clearly superior achievement. significant summer law office clerk experience; or significant participation in a clinical legal aid program; significant participation in the law school's moot court competition. significant participation on the law school's law review; graduation with academic honors. Candidates should have excellent oral communication, writing, research and analysis skills, and the ability to work effectively with other people, and exercise sound judgment. In order to better assess your qualifications for this position, when preparing your resume and cover letter please be sure to address experience, skills, and substantive knowledge in the following areas of legal work: - Researching and writing legal memoranda and opinions and providing legal advice or recommendations to clients, judges, and/or senior attorneys. - Litigating in Federal court and preparing transactional agreements and other documents; and evidentiary privileges and e-discovery, including familiarity with technology associated with the electronic search, retrieval, and review of documents - Experience in or familiarity federal administrative law issues, such as matters arising under the Administrative Procedure Act (including rulemaking), 25 C.F.R. Part 151, the Indian Reorganization Act, the National Environmental Policy Act, the Comprehensive Environmental Response, Compensation, and Liability Act, the Indian Gaming Regulatory Act, the Long-Term Leasing Act, the Indian Rights of Way Act, and the Native American Graves Protection and Repatriation Act.
