Duties
The Office of Associate Chief Counsel (Employee Benefits, Exempt Organizations and Employment Taxes), Washington D.C., provides legal advice and litigation support services on tax matters involving employee plans, exempt organizations, employment taxes, executive compensation, health and welfare benefits, and certain federal, state, local and Indian Tribal government issues to a wide variety of internal and external customers and clients. The employment tax branches prepare regulations, revenue rulings, revenue procedures, notices, and announcements in connection with employment tax issues, including areas such as FICA/FUTA/income tax withholding, employment tax reporting, fringe benefits, self-employment tax, and worker classification. The branches also issue private letter rulings, technical advice memoranda and Chief Counsel Advice relating to employment taxes. The branches also provide litigation support assistance in connection with the defense, settlement and processing of cases pending in the United States Tax Court, and refund cases filed in district courts and the Court of Claims and reviews tax legislation.
As a General Attorney (Tax) - Assistant to the Branch Chief, you will perform a full range of professional legal services and management related duties. You will perform the full range of legal work within the Branch, serve as a technical reviewer, and perform specific management duties as assigned. Assignments include but are not limited to:
Serving as the principal drafter or as the reviewer of regulations; working with others in Chief Counsel, the IRS, and Treasury Department in the development of regulations; briefing of policy and legal issues; and moving regulations through the extensive review process.
Drafting or reviewing revenue rulings, revenue procedures, and other items for publications. Effecting all necessary coordination of proposed publications and working out differences of opinion between reviewing offices.
Analyzing and preparing or reviewing responses to requests for private letter rulings submitted by taxpayers and their representatives. Conducting taxpayer conferences and explaining the IRS' position to taxpayers and their representatives during the conferences.
Processing requests for technical advice received from field offices of the IRS. Working with personnel of the field offices to ensure that all relevant information has been obtained and that the proposed answer to the technical advice request is responsive and workable.
Participating in the briefing of significant issues to reviewers at all levels of Chief Counsel, the IRS, and Treasury Department.
Planning work to be accomplished by subordinates. Determining work priorities and preparing work schedules for completion of work. Assigning work to subordinates based on priorities, the difficulty and requirements of the assignment, and the capabilities of the employees.
Reviewing work products of subordinates and accepting, revising, or rejecting work. Supporting accomplishment of work products and providing guidance in research and analyzing novel and uncertain points of law, etc.
Accomplishing objectives through effective communications and within appropriate time constraints while working with a minimum of supervision and independently performing duties of this position.
Preparing and reviewing management reports and performing other administrative duties as assigned.
THIS IS A DETAIL POSITION NOT-TO-EXCEED 1 YEAR. AT THE END OF THIS 1-YEAR ASSIGNMENT, INCUMBENT WILL RETURN TO THEIR FORMER POSITION OF RECORD. THIS POSITION MAY BE EXTENDED FOR AN ADDITIONAL 1 YEAR WITHOUT FURTHER COMPETITION.
