Duties

OGC is the legal office for the Foundation, providing legal advice, assistance, and advocacy on all aspects of the Foundation's programs, policies, and operations, as well as areas affecting science and technology more broadly. Advice is provided in a wide variety of areas, such as: grants, contracts and cooperative agreements; intellectual property; conflicts-of-interest; employee and labor relations; civil rights; health, safety and environment; Federal fiscal and administrative law and procedure; and international law and agreements. OGC coordinates with U.S. Department of Justice regarding litigation matters involving the foundation. The individual selected for this position will serve as an Assistant General Counsel. The Assistant General Counsel will be responsible for providing advice and guidance related to a range of Federal government Information Law and privacy matters, including those arising under the Freedom of Information Act (FOIA), the Privacy Act of 1974, E-Government Act of 2002, the Federal Advisory Committee Act (FACA), Government in the Sunshine Act, Paperwork Reduction Act (PRA), and the Administrative Procedure Act (APA). Additionally, the Assistant General Counsel will: Counsel Foundation leadership, including the leadership of the Science Directorates and Mission Offices with respect to legal and policy aspects of major awards and declined proposals, and other matters of government information law and regulation. Provide fully researched legal advice on substantive, procedural, and administrative regulations and policies. Consult with and render opinions to all levels of management in interpreting and applying such regulations. Facilitate NSF partnerships and memoranda of understanding by advising on government information and data considerations. Provide advice on matters related to litigation holds, third party subpoenas, requests for information and Touhy regulations. Review, revise, and/or draft System of Records Notices and Privacy Impact Assessments under the Privacy Act. In disputed cases and appeals within the portfolio, prepare (or support the Department of Justice in preparing, as applicable) the Foundation's written legal responses, including but not limited to trial briefs, subpoenas, motions, answers, depositions, proposed findings of fact and conclusions of law, and appeal briefs. Serve on working groups and provide legal support on inter-agency initiatives related to information security, data use, and data sharing. Serve as a legal expert on a variety of legal issues such as privacy law, information security law, and information governance.

Requirements

Qualifications

Candidates must have a J.D. from a school of law accredited by the American Bar Association (ABA), plus after award of the J.D., eight or more years of professional legal experience. Candidates must have expertise related to the areas of law relevant to the position for which they wish to be considered, as articulated in the Duties and Experience section above. Bar Membership: Member in good standing of the bar of a State, territory of the United States, District of Columbia, or Commonwealth of Puerto Rico. Also desirable, but not required, is experience involving litigation, legislation, and Congressional and other forms of oversight.
