Duties
The Designated Agency Ethics Official and Senior Assistant General Counsel serves as a member of the leadership team in the Office of the General Counsel (OGC). OGC is the legal advisor and advocate for the Foundation, providing legal advice and assistance on all aspects of the Foundation's programs, policies, and operations, as well as areas affecting science and technology more broadly. OGC advice is provided in a wide variety of areas, such as: grants; contracts and cooperative agreements; intellectual property; conflicts-of-interests; employee and labor relations; civil rights; health, safety and environment; public regulation of research; Federal fiscal and administrative law and procedure; international law and agreements; and national security restrictions of scientific research (including export controls).
The incumbent participates with and assists the General Counsel in managing the office responsible for rendering counsel and advice to the Director, NSF Management officials, and agency staff on legal and ethics issues. The incumbent will apply a wide range of legal knowledge, expertise, and judgment to all phases of the Foundation's operations, including grants and contracts, ethics, appropriations law, Freedom of Information Act (FOIA) and Privacy Act, Federal personnel law, intellectual property (including rights in data), environmental law, and export controls. The incumbent supervises the OGE Ethics Team and coordinates the distributed network of NSF Conflicts Officials and represents the General Counsel at senior-level interagency meetings. Additionally, the incumbent supervises the FOIA Team and the Government Information Law and Personnel attorneys.
Qualifications
EXECUTIVE CORE QUALIFICATIONS (ECQs): Unless you are currently under a career SES appointment, are eligible for reinstatement into SES, or have successfully completed a SES Candidate Development Program approved by OPM, you must submit written statements (narrative format) describing accomplishments that would satisfy the ECQs. If you fail to do so, you will be rated as "ineligible."
1. Leading Change. This core qualification involves the ability to bring about strategic change, both within and outside the organization, to meet organizational goals. Inherent in this ECQ is the ability to establish an organizational vision and to implement it in a continuously changing environment.
2. Leading People. This core qualification involves the ability to lead people toward meeting the organization's vision, mission, and goals. 3. Results-Driven Leadership. This core qualification involves the ability to meet organizational goals and customer expectations. Inherent in this ECQ is the ability to make decisions that produce high-quality results by applying technical knowledge, analyzing problems, and calculating risks.
4. Business Acumen. This core qualification involves the ability to manage human, financial, and information resources strategically.
5. Building Coalitions. This core qualification involves the ability to build coalitions internally and with other Federal agencies, State and local governments, non-profit and private sector organizations, foreign governments, or international organizations to achieve common goals.
MANDATORY TECHNICAL QUALIFICATIONS (MTQs): All applicants must submit written statements (narrative format) of accomplishments that would satisfy the MTQs for this vacancy. You must address each MTQ qualification separately.
Applicants must have a J.D. or L.L.B. degree from an ABA-accredited law school and must maintain an active license to practice law in a State, territory, the District of Columbia, or the commonwealth of Puerto Rico.
Demonstrated knowledge and substantial experience interpreting and providing advice to Senior Agency officials, Presidentially appointed officers, and Presidentially appointed and Senate-confirmed officers on Federal conflict of interest laws, the Standards of Conduct for Employees of the Executive Branch, and the Hatch Act with regard to the Intergovernmental Personnel Act, Research Integrity, and Procurement Integrity.
Experience and expertise in reviewing and providing assistance on financial disclosure requirements, including the completion of Forms 278 and 450.
Experience preparing comprehensive legal documentation including drafting opinions, developing and implementing ethics training programs, and coordinating nominations and other matters, as required, with the Office of Government Ethics and other Federal agencies.
Demonstrated experience coordinating with external scientific or engineering communities or with the internal Federal infrastructure for the support of science and engineering research and education, in at least three of the following areas: 1) federal grants administration, 2) intellectual property (including data rights), 3) personnel authorities including IPAs and experts, 4) scientific misconduct, and/or 5) government information.
When responding to the MTQ and ECQ qualifications, you must clearly show that you possess the experience, knowledge, skills and ability to perform the duties of this position by submitting narrative responses in which you detail your experience in each of the ECQs and MTQs.
Your examples should be clear and emphasize your level of responsibilities, scope, and complexity of the programs managed and program accomplishments with results of your actions, policy initiatives and level of contacts.
Applicants who do not provide narrative statements addressing both the ECQs and MTQs will be rated as ineligible.
Applicants currently serving under a career Senior Executive Service (SES) appointment, eligible for reinstatement into SES, or have successfully completed a SES Candidate Development Program (CDP) approved by OPM are not required to address the Executive Core Qualifications (ECQ); but a narrative statement for each of the Mandatory Technical Qualifications (MTQ) is required.
