Duties

The primary role of HUD's Office of Litigation is to defend the agency and its programs in federal court litigation. In doing so, the Office of Litigation works with the Department of Justice to handle all aspects of the litigation process. The Office handles HUD's most consequential and precedential lawsuits, which involve constitutional, statutory, regulatory, and contractual challenges to HUD programs nationwide. Its attorneys gather facts, develop litigation strategy, draft briefs, and negotiate settlements. The Office is also responsible for providing assessments of litigation risk regarding proposed HUD actions and policies, along with expert legal advice derived from such assessments. This is a supervisory attorney position for one who will---working with the Assistant General Counsel in one of two divisions within the Office of litigation---lead and oversee the work of attorneys in that division, while also contributing to the management and legal expertise of the Office of Litigation as a whole. As a/an Supervisory Trial Attorney (Deputy Assistant General Counsel), you will: Supervise the staff of the Insured Housing and Community Development Litigation Division. Supervise the development of pertinent facts and the presenting of evidence, and the development of legal arguments and the conduct of research. Review and edit letters, memoranda, and court papers. Decide questions of litigation strategy and tactics which are beyond staff attorney's scope of authority. Discuss with all interested persons, including program officials and Department of Justice attorneys, factual, legal and policy problems raised by litigation, and takes appropriate action to affect their resolution. Maintain knowledge on current law in program areas of primary responsibility. Supervise trial attorneys and senior trial attorneys assigned to either Division of the Office of Litigation in the handling of litigation assigned to either Division of the Office, including lawsuits predominantly involving the Department's assisted housing programs and civil rights, fair housing and discrimination issues, and any other issues not subsumed in the stated categories. Review and make recommendations to the Assistant General Counsel concerning appeals and non-routine settlement proposals in non-Office cases involving insured housing and community development programs issues and, upon request of the Associate General Counsel, in cases involving assisted housing and civil rights issues. Review and prepare comments on draft regulations and legislation, as requested. Participate in formulating litigation policy, subject to the general direction of the Assistant General Counsel and provides advice on policy to other HUD attorneys.

Qualifications

You must meet the following requirements by the closing date of this announcement. Basic Requirements: Applicants MUST: (1) be a graduate of an accredited law school with an LL.B. or J.D.; (2) be a current member of a bar with a valid license to practice law in a state, territory of the United States, District of Columbia, or Commonwealth of Puerto Rico; and (3) meet all specialized experience requirements as described in the vacancy announcement. AND Specialized Experience: For the GS-15: You must have one year of specialized experience at the GS-14 grade level in the Federal service or equivalent. Specialized experience for this position is defined as: - Leading teams of attorneys and paralegals in legal work in connection with litigation as exemplified by the preparation of legal opinions, briefs, pleadings, memoranda, and correspondence; the performance of legal research projects; the provision of legal advice to clients; and the handling of all phases of litigation; AND - Drafting and responding to legal pleadings, motions, and discovery in federal courts; AND - Reviewing proposed actions to identify and mitigate potential litigation risks found in the review; AND - Maintaining effective working relationships with clients, staff, and professional peers. For the GS-15, you must: Have a professional law degree (LL.B. or J.D.), plus five (5) years of professional legal experience, at least one of which must be specialized experience at a level of difficulty comparable to the GS-14 level in the Federal service. OR Have a second professional law degree (LL.M.) plus four (4) years of professional legal experience, at least one of which must be specialized experience at a level of difficulty comparable to the GS-14 level in the Federal service. OR Have a first professional law degree (LL.B., or J.D.), plus superior law student work (academic standing in upper 1/3 of the law school graduating class, high-level honors for academic excellence in law school, winning of a moot court competition with other law schools, significant work or achievement on the school's official law review, significant summer clerkship or other evidence of clearly superior achievement) plus four (4) years of professional legal experience, at least one of which must be specialized experience at a level of difficulty comparable to the GS-14 level in the Federal service. The experience may have been gained in either the public or private sector. One year of experience refers to full-time work; part-time work is considered on a prorated basis. Education

Attorney positions do have an education requirement.

Applicants must be a graduate of an accredited law school with an LL.B. or J.D. For positions with an education requirement, you MUST submit a copy of your transcripts or equivalent. An official transcript will be required if you are selected. In addition you must provide proof of bar or your bar number in the vacancy questions.

The education generally must be from an accredited (or pre-accredited) college or university recognized by the U.S. Department of Education. If you are qualifying based on foreign education, you must submit proof of creditability of education as evaluated by a credentialing agency. Refer to the OPM instructions.
