This position is located in the U.S. Department of Labor (DOL), Benefits Review Board (BRB).
Duties
The BRB is an appellate board whose mission is to review appeals of administrative law judges' decisions arising under the Black Lung Benefits Act and the Longshore and Harbor Workers' Compensation Act and its extensions, including the Defense Base Act. The BRB determines whether the administrative law judge's findings are supported by substantial evidence and are in accordance with law. The Board's decisions may be appealed to the U.S. Courts of Appeals in the circuit where the injury arose, and from there to the U.S. Supreme Court. The Board, by statute, consists of five Members appointed by the Secretary of Labor, one of whom is designated as Chair and Chief Administrative Appeals Judge.
The following are some Member-Benefits Review Board duties:
Serves as the Member of the Benefits Review Board and assists the Chair in the operational and administrative management of the Board as well as assisting with directing and supervising the Board's members and in the performance of the Board's functions. The operational and administrative management duties include managing the Board's legal, supervisory, administrative and clerical staff; policy decisions, technology proposals, personnel and disciplinary matters, union matters and all other management duties.
Considers and decides, with other members of the Board, appeals and other matters which come before the Board as required by law and any applicable regulations, applying and interpreting statutes, regulations and case-law to come to a determination or, as appropriate, to write a separate concurring and/or dissenting opinion in cases involving a broad range of legal, medical, economic and technical issues which affect the entire maritime and coal mining industries.
Participates with the Chair, and other Board Members and Alternate Members, at oral argument presented by the parties or their authorized representatives. explanation.
Qualifications
To be deemed qualified, candidates must submit a complete application and possess legal and management experience having developed the knowledge and skills required for effective performance of the specific duties of the position and meeting the experience requirements and evaluation factors listed below. Candidates must have specialized experience at a major management level (normally equivalent to the GS-15 level in the federal service).
SPECIALIZED EXPERIENCE: The applicant should be well versed in law and the appeals process as well as have the ability to interpret regulations and to come to a consensus to determine an overall appeals determination with members of the Board.
Education
This position has a Positive Education Requirement. Applicants must possess a J.D. and will be required to provide an original copy of their transcripts if selected. Applicants are required to be active members of the Bar in any US State or US Territory Court under the U.S. Constitution. Documentation of Bar License will be required before selection.
You must provide a copy of your transcripts from an accredited institution. Any applicant falsely claiming an academic degree from an accredited school will be subject to actions ranging from disqualification from federal employment to removal from federal service.
