***This position is open to current CFTC Employees*** The mission of the U.S. Commodity Futures Trading Commission (CFTC) is to protect market participants and the public from fraud, manipulation, abusive practices and systemic risk related to derivatives – both futures and swaps – and to foster transparent, open, competitive and financially sound markets.  

Duties

This position is located in the Office of the General Counsel (OGC), Litigation Branch. The Litigation Branch represents the Commission in the U.S. Courts of Appeals, District Courts, Bankruptcy Courts, and various administrative bodies. OGC litigation staff represents the Commission principally in challenges to agency actions under the Administrative Procedure Act, appeals of CFTC enforcement actions, subpoenas directed to the CFTC, derivatives-industry bankruptcies, and as amicus curiae in a range of matters. The Branch also reviews draft regulations, releases, and other proposed agency actions for litigation risk, including but not limited to compliance with the Administrative Procedure Act and Commodity Exchange Act (CEA) provisions. The Branch advises the Commission on administrative cases arising from its reparations program and from certain exchange or National Futures Association decisions.

Qualifications

To qualify for the CT-15, applicants must have the following: CT-15: Applicants must have a J.D. Degree, bar membership and Five years of relevant legal practice experience, acquired after being admitted to the bar, commensurate with the duties and responsibilities of a legal position. Relevant experience is defined as an attorney, law clerk, or other legal experience which was obtained subsequent to graduation from law school.   Qualifying experience may include: Experience in applying knowledge of the Commodity Exchange Act, the Securities Act of 1933 and the Securities Exchange Act of 1934, with general administrative law, and federal civil and appellate practice and procedure. Experience in evaluating and comparing the legal risks inherent in various possible courses of action.

Education

Education: Successful completion of a full course of study (JD) in a school of law accredited by the American Bar Association (ABA).

Education must be accredited by an accrediting institution recognized by the U.S. Department of Education in order for it to be credited towards qualifications. Therefore, provide only the attendance and/or degrees from schools accredited by accrediting institutions recognized by the U.S. Department of Education.
