This position is located in the Office of the General Counsel, Executive Office for Immigration Review, U.S. Department of Justice. Incumbent serves as an Attorney Advisor (General) performing duties involving privacy law and compliance, reasonable accommodations, records and information management, audits, and other complex legal matters facing the agency.
This is a Competitive Service position; additional positions maybe filled from this announcement within 90 days of certificate issuance.
Duties
Duties include but are not limited to the following:
Provides counsel and guidance to explain legal considerations and analysis affecting component program operations, as required for compliance with federal law, including but not limited to the Immigration and Nationality Act, the Privacy Act, the FOIA, the Rehabilitation Act, the Americans with Disabilities Act, and the Paperwork Reduction Act.
Provides legal counsel on a variety of complex matters affecting EOIR, the mission of EOIR, and matters relating to the administration of law in assisting with the day-to-day functions and legal operations of EOIR.
Reviews proposed changes in applicable laws and regulations, solicits comments, and formulates proposed EOIR positions for presentation to senior agency officials, Congress, the Executive, or regulatory agencies.
Prepares legal opinions and analysis responding to questions raised in the consideration and evaluation of key legal issues in conjunction with other components of EOIR.
Provides legal counsel and advice to the Supervisory Attorney Advisor, the Deputy General Counsel, the General Counsel and senior agency officials on extremely complex and controversial matters of law and policy impacting the agency, including in the areas of immigration law, privacy, records and other General Law Unit matters. Disseminates information and guidance to field attorneys and agency staff.
Provides guidance and assistance on operational, legal, and policy issues with other federal agencies or non-governmental organizations.
Performs other General Law Unit duties, as assigned.
Requirements

Qualifications
In order to qualify for the Attorney Advisor (General) position, you must meet the following minimum qualifications:
Education: Applicants must possess an LL.B., J.D., or LL.M degree. (Provide the month and year in which you obtained your degree and the name of the College or University from which it was conferred/awarded.)
AND
Licensure: Applicants must be an active member of the bar, duly licensed and authorized to practice law as an attorney under the laws of any state, territory of the U.S., or the District of Columbia. (Provide the month and year in which you obtained your first license and the State from which it was issued.)
AND
Required Experience:
For GS-14: Applicants must have three (3) full years (36 months) of post J.D., LL.B, or LL.M professional legal experience.
Qualifying professional legal experience includes: Researching, analyzing and providing legal interpretations of applicable federal laws and regulations, including but not limited to the Immigration and Nationality Act, the Privacy Act, the FOIA, the Rehabilitation Act, the Americans with Disabilities Act, and the Paperwork Reduction Act; Researching, analyzing and providing legal interpretation of a wide range of federal statutes, including procedural and substantive issues, and relevant constitutional, statutory, judicial and regulatory law. Determines the requirements for compliance with such statutes and disseminates information and guidance accordingly; Reviewing proposed changes in applicable laws and regulations, soliciting comments and formulating agency positions; Expert knowledge, legal skill and competence interpreting statutes and Executive Orders and evaluating sensitive situations involving federal law, specifically privacy law and compliance; Assisting in responding to audits and investigations initiated by other departmental components and Federal Agencies; and Effective oral communication and negotiation skills in order to build effective working relationships with all levels of agency personnel, as well as the ability to persuade individuals, attorneys, government officials and others to accept legal decisions, or changes in policy, procedures, laws and regulations. (NOTE: qualifying experience is calculated only after receipt of J.D., LL.B or LL.M)
For GS-15: Applicants must have four (4) full years (48 months) of post J.D., LL.B or LL.M professional legal experience.

Preferred Experience:
The ideal candidate will have experience with the following:
Providing legal counsel on a variety of complex legal issues affecting agency operations and legal compliance.
Providing technical guidance to field attorneys and agency staff.
Providing input and advice to senior officials on legal and policy decisions.
Analyzing and providing recommendations and guidance for agency compliance with the Privacy Act and other federal statutes.
Coordinating with other government offices and/or agencies on legal matters.
