About the Position: The Memphis District Office of Counsel is comprised of the District Counsel, a Deputy District Counsel, seven Assistant District Counsels and one paraprofessional. The Memphis District is one of 43 Corps districts worldwide and one of six districts in the Corps' Mississippi Valley Division (MVD). We deliver flood risk management, navigation, environmental stewardship, emergency operations, other authorized civil works and work for others to benefit the region and the Nation.

Duties

Perform assignments independently for a supervisory counsel; accomplishes a variety of legal work necessary to the mission and activities of the Memphis District. Assignment require full professional legal training; familiarity with decisions, pertinent regulations, precedent-setting decisions of higher authority; and professional knowledge of the various specialized fields of law and practice indicated below: Counsel for labor relations, employment, EEO and personnel law. Review changes to District policies for legal sufficiency and labor implications. Advise on grievances, complaints, MSPB appeals, Whistleblower proceedings, and ULP complaints. Furnish full procurement legal advice from contract formation, through administration, dispute resolution, and litigation on wide-variety of contracts including construction, supplies, services, architect-engineer, water supply storage. Provide full legal services with Memphis District and regional civil works planning, design, construction, operation, and maintenance (PPA formation, authorities, cost-share requirements, environmental and cultural resources compliance). Serve as Trial Attorney on contractual, tort, takings, affirmative claims and enforcement, and/or personnel law cases in administrative tribunals and federal court venues, from inception through resolution. Counsel on fiscal law and appropriations requiring, interpretation of statutes, research and interpretation of annual appropriations and authorization legislation, Advise on ethics/standards of conduct legislation and regulations; provides in/out briefings and training; advises on source selection; conducts fact finding and written ethics determinations; ensures compliance with financial reporting. Serve as legal advisor or reviewer on Commander Inquiries and AR 15-6 investigations; and, at the request of the Division Counsel, throughout MVD. Provide legal support to USACE regulatory permit program; provides legal advice and guidance on all aspects USACE environmental programs/documents, including cultural resource compliance.

Requirements

  • Appointment may be subject to a suitability or fitness determination, as determined by a completed background investigation.
  • Obtain and maintain a SECRET security clearance.
  • This position requires the incumbent to submit a Financial Disclosure Statement, OGE-450 (5 CFR 2634, subpart 1 USOGE, 6/08) upon entering the position and annually thereafter.
  • Must maintain active status, in good standing, with at least one attorney licensing authority. Must provide certification of this status upon appointment and every two years thereafter.

Qualifications

Who May Apply: US Citizens In order to qualify, you must meet the education and/or experience requirements described below. Experience refers to paid and unpaid experience, including volunteer work done through National Service programs (e.g., Peace Corps, AmeriCorps) and other organizations (e.g., professional; philanthropic; religious; spiritual; community; student; social). You will receive credit for all qualifying experience, including volunteer experience. Your resume must clearly describe your relevant experience; if qualifying based on education, your transcripts will be required as part of your application. The following minimum qualification requirements must be met before applicants are eligible for further consideration: Education: An applicant must have successfully completed a full course of study in a school of law accredited by the American Bar Association (ABA) and have the first professional law degree (LLB or JD). (You must submit a copy of your transcripts). Bar Membership: Applicant must currently be a member in good standing of the bar of a state, territory of the United States, District of Columbia, or Commonwealth of Puerto Rico. (You must submit a copy of your current certification). Experience Required: To qualify for the GS-14 grade level, applicant must have more than three years of professional legal experience commensurate with the duties and responsibilities of the positions. TIME IN GRADE REQUIREMENTS: Applicants currently employed as an Attorney by the Federal government must have completed one year of time-in-grade at the next lower grade level (GS-13) or the equivalent within 30 days of the closing date of the announcement, or previously served at the same or higher grade as the position being filled. You will be evaluated on the basis of your level of competency in the following areas: Your application package (resume and supporting documents) will be reviewed to verify that you meet the basic eligibility and qualification requirements. If qualified, your application package will be evaluated as to whether and how your experience, knowledge, skills, training and/or education clearly reflect that you possess the following required knowledge, skills, and abilities (KSAs) to successfully perform the duties of this position: Knowledge and experience in procurement matters from contract formation through dispute resolution, and contracts litigation; fiscal law and appropriations; and general federal law topics including Employment law, Tort Claims, Admiralty, and Takings litigation. Knowledge of handling complex litigation in federal courts and before federal administrative tribunals. Ability to work effectively in a team environment, especially with other attorneys, to develop legal approaches, balancing and coordinating the assignment of roles and responsibilities, while achieving positive results. Ability to function as a senior counselor and advisor to the Commander; to work effectively with other military and senior management officials within the U.S. Army Corps of Engineers, with other governmental entities, and with private parties. Ability to communicate clearly and persuasively, both orally and in writing, with diverse clients and constituencies on varied and complex topics.
