This position is located in the Department of Health & Human Services (HHS), Centers for Medicare & Medicaid Services (CMS), Offices of Hearings and Inquiries (OHI), Office of Hearings (OH), Division of Provider Reimbursement Review Board (PRRB) Services. As a Attorney-Adviser, GS-0905-13, you will review administrative appeals, identifying and analyzing complex legal issues in order to provide advice, recommend actions, and draft proposed Board actions.

Duties

Develops, prepares and writes PRRB substantive decisions, ensuring that all aspects of the case are identified and properly addressed. Performs a wide variety of advisory, technical and administrative services in managing the adjudication of adversarial disputes relating to Medicare payment and reimbursement. Advises and assists the parties’ legal counsel and other representatives on legal, technical, and substantive aspects of preparing for a hearing before the Board. Prepares analyses integrating all procedural and evidentiary documentation to show the nature of the cases; the bases for jurisdiction; the bases for the parties' positions; and the applicable law, regulations, policies and other governing criteria. Provides oral and written advice and legal guidance to the Board based on this analysis.

  • Bar Membership Required: Admission to the bar of any State, territory, Commonwealth of Puerto Rico, District of Columbia, or Federal Court is acceptable. Employees must maintain active bar membership while employed as an attorney with HHS.
  • This job will be filled by an alternative hiring process and is not in the competitive service. Applicants selected for an excepted service position may be subject to a two-year trial period.

Qualifications

ALL QUALIFICATION REQUIREMENTS MUST BE MET WITHIN 30 DAYS OF THE CLOSING DATE OF THIS ANNOUNCEMENT. Experience requirement for GS-13: Requires 2 years of professional legal experience post bar admission, with one year of experience equivalent to the GS-12 level. Bar membership requirement: HHS Attorney positions require current active bar membership. Admission to the bar of any State, territory, Commonwealth of Puerto Rico, District of Columbia, or Federal Court is acceptable. Employees must maintain active bar membership while employed as an attorney with HHS. Active bar membership is verified prior to appointment. Experience refers to paid and unpaid experience, including volunteer work done through National Service programs (e.g., Peace Corps, AmeriCorps) and other organizations (e.g., professional; philanthropic; religious; spiritual; community, student, social). Volunteer work helps build critical competencies, knowledge, and skills and can provide valuable training and experience that translates directly to paid employment. You will receive credit for all qualifying experience, including volunteer experience.

Education

Education Requirement: In addition to meeting the qualification requirements, HHS Attorney positions have a minimum requirement of a Juris Doctorate (J.D.) or Bachelor of Laws (LL.B.) from an accredited school.
