You will serve as a senior trial attorney and manager, providing program direction and technical leadership in the CHRO. As an expert in a specialized area of law, the supervisory trial counsel conducts litigation of the most complex SEC cases, such as sanctions against well-known entities and individuals; collections and distributions; prosecution of misconduct by attorneys appearing and practicing before the SEC; and bankruptcy and insolvency cases.

Duties Include: Plans, organizes, and conducts trials of the most difficult and complex cases, which typically result in the establishment of innovative trial techniques and/or major legal precedents. Cases may be highly sensitive. Prepares witnesses and experts for deposition and trial testimony. Deals with opposing counsel. Argues motions in court and attends all other court proceedings, conferences, and hearings in litigation. Synthesizes divergent views and facts for litigation. Provides effective leadership in the preparation, review, and revision of all case related legal papers, briefs, and memoranda, including injunctive actions and administrative proceedings. Directs legal pleadings, such as briefs, motions, etc., in civil and administrative proceedings. The individual is the chief advocate for the SEC throughout the duration of litigation and speaks on behalf of the SEC in court and with government officials from other federal and state organizations and private industry. Serves as a technical expert for special studies or investigations involving novel or unexplored questions of law or policy. Recommends enforcement actions or prepares drafts of new rules, releases, or legislation. Represents the SEC in dealings with the U.S. Attorneys, Congressional staff, and legal staffs related to criminal investigations, presentation of matters to a federal grand jury, criminal trials, and appeals. Advises SEC executive management with regard to legal strategy. Exercises a full range of supervisory and personnel management roles related to work performed by subordinate staff including ensuring quality work product and objectives, training, employee grievances, disciplinary action, hiring, promotions, performance appraisals, EEO, etc. Provides executive leadership and management of the staff and work products by maintaining and exhibiting knowledge, insight, and understanding of the assigned specialized area of trial law. Fosters productive work relationships with federal and state regulators and criminal authorities.

• This position is open to Current permanent SEC employees in the excepted service (i.e., attorney candidates) within the Division of Enforcement, Chicago Regional Office.

Qualifications

All qualification requirements must be met by the closing date of this announcement. Qualifying experience may be obtained in the private or public sector. Volunteer work helps build critical competencies, knowledge, and skills and can provide valuable training and experience that translates directly to paid employment. You will receive credit for all qualifying experience, including volunteer experience. Qualifying education must have been obtained from an accredited college or university recognized by the U.S. Department of Education. BASIC REQUIREMENT: All applicants must possess the following J.D. or LL.B. degree --AND-- Active membership of the bar in good standing in any state, territory of the United States, the District of Columbia, or the commonwealth of Puerto Rico. (Note: proof of bar membership will be required before entry on duty. MINIMUM QUALIFICATION REQUIREMENT: In addition to meeting the basic requirement, applicants must also meet the minimum qualification requirement. SK-17: Applicant must have one year of specialized experience equivalent to the GS/SK-14/15 level. Specialized experience includes: identifying legal issues, providing legal analyses, providing legal solutions/recommendations, and preparing legal documents, such as contracts, dispositions, pleadings, and motions and must also include: (1) Litigating complex civil or criminal cases in Federal Court or Administrative Proceedings; and (2) Applying the Federal Rules of Civil Procedure and the Federal Rules of Evidence.
