The Investigator position provides direct support/assistance to higher level investigators and managers and conducts research on policy, program, and case related issues and questions, and gathers and evaluates data relevant to specific cases. This position is responsible for planning, directing, and administering a program of enforcement to ensure maximum compliance with ERISA and the criminal provisions of the United States Code as they relate to employee benefit plans.
Duties
Major duties include but are not limited to:
Provide insight and guidance regarding the interpretation and implementation of EBSA's statutory responsibilities under the criminal provisions of Title I of the Employee Retirement Income Security Act of 1974 (ERISA); Title 18 United States Criminal Code; and other related laws.
Formulate, recommend, and oversee the implementation of the strategies, methodologies, targeted criteria, procedures, reporting and accountability systems, and guidance that form the basis for the EBSA enforcement program.
Coordinate enforcement efforts to ensure a comprehensive enforcement presence across the country. As determined necessary, or at the request of other agency components and field office management, provides technical direction, advice, and guidance on the conduct of investigations; participates or assists in conducting investigations; reviews the evidentiary and legal sufficiency of investigations before their referral to the Solicitor of Labor or other Federal or State prosecutors for litigation.
Formulate inter-agency working agreements to reinforce cooperative enforcement and litigation efforts. Develop close and cooperative working relationships with other DOL components, other Federal agency senior and executive staff authorized to investigate ERISA and/or criminal matters, and State agencies that have authority to conduct investigations related to ERISA covered plans within their respective states.
Clarify and resolve questions of jurisdiction, policy, and strategy; formulate interagency teams to conduct joint investigations; jointly formulate investigative priorities and initiatives; discuss resolution of precedential and national enforcement problems enforcement efforts; discuss improvement of enforcement efforts and methodologies; participate in and/or lead interagency enforcement training efforts.
Recommend possible changes in the EBSA program strategy and initiatives. Provide technical direction, advice, and guidance on the conduct of investigations. Review the evidentiary and legal sufficiency of investigations and provide feedback, when appropriate.
Review the evidentiary and legal sufficiency of investigations before disposition/referral. Develops written guidance and training materials.
Formulate inter-agency working agreements to reinforce cooperative enforcement and litigation efforts. Provide analytical comments
and position papers that address the impact of policy, regulatory, and legislative changes and court decisions on the EBSA enforcement program.
Develop written guidance and training materials and present training related to ERISA enforcement and policy.
Performs other related duties as assigned.
Requirements
- Must be a U.S. Citizen.
- Must be at least 16 years old.
- Candidate required to obtain the necessary security/investigation level.
- Requires a probationary period if the requirement has not been met.
- Driver's License is desirable but not required.
Qualifications
You must meet the Specialized Experience to qualify for the Employee Benefits Investigator (Senior Advisor, Criminal Investigator) position, as described below.
For GS-14 level: Applicants must have 52 weeks of specialized experience equivalent to at least the next lower grade level GS-13 in the Federal Service.
Specialized Experience is the experience that equipped the applicant with the particular knowledge, skills, and abilities (KSA's) to perform the duties of the position successfully, and that is typically in or related to the position to be filled. To be creditable, specialized experience must have been equivalent to at least the next lower grade level.
Qualifying specialized experience for this GS-14 position includes:
1) Developing and applying investigative methodologies and approaches appropriate to the investigation of complex financial practices applied by employee benefit plan fiduciaries and service providers.
2) Implementing criminal prosecution processes and procedures; and
3) Working with other Federal and State agency enforcement representatives to improve the effectiveness of the investigation of white collar crimes.
Education
There is no substitution of education for experience at the GS-14 level for this position.
