This position is located in the Legal Division, Supervision, Legislation and Enforcement Branch, Bank Activities and Regional Affairs Section (BARAS), New York Regional Office (Consumer) of the Federal Deposit Insurance Corporation. BARAS provides legal advice and counsel on all open bank legal matters in coordination with the other sections in the Legal Division and other FDIC Divisions.

Duties

Provides advice, assistance, and recommendations and serves as one of the region’s senior consumer protection and compliance staff members on highly complex, high profile legal issues, the interpretation and enforceability of pertinent banking laws, and the appropriate handling of questions, actions and applications involving various sections of the FDI Act, and other pertinent laws and regulations related to banking. Prepares legal advisory opinions in response to questions and issues relating to the interpretation of Federal Deposit Insurance Act (“FDI Act”), Federal banking laws and regulations, and various statutes and regulations governing the activities, operations, and structure of open operating financial institutions related to consumer protection and compliance. Advises the Regional Counsel and Counsel in developing and managing enforcement activities of the region in consumer protection and compliance administrative and civil enforcement proceedings and investigations, related to violations of consumer protection and compliance laws and regulations. Serves as a principal or lead counsel and advisor in administrative enforcement proceedings regarding consumer protection laws and regulations. Litigates consumer enforcement cases or actions; prepares evidence and legal arguments in administrative proceedings before administrative law judges; prepares briefs, pleadings, motions, opinions, correspondence, and legal memoranda in connection with such proceedings; prepares and examines witnesses; and negotiates with opposing counsel; and may conduct investigations. Coordinates and reviews the work of consumer protection and compliance attorneys and paralegals, and less experienced FDIC attorneys, as directed.

Qualifications

Specialized experience must be directly related to the position being filled and is experience gained after issuance of bar membership. This position has a positive education requirement, transcripts must be provided showing degree conferred. Official transcripts must be provided prior to appointment. Education: All attorney and law clerk trainee positions have a minimum education requirement of a Juris Doctorate (J.D.) or Bachelor of Laws (LL.B.) or Master of Laws (LL.M.) from a school  accredited by the American Bar Association (ABA). Bar Membership: All attorney positions require current active bar membership (valid license to practice law). Admission to the bar of any state, District of Columbia, any United States territory or Commonwealth, or Federal Court is acceptable. Active Bar membership must be verified prior to appointment. Employees must maintain active bar membership while employed as an attorney with the FDIC. Qualifying experience may be obtained in the private or public sector. Experience refers to paid and unpaid experience, including volunteer work done through National Service programs (e.g., Peace Corps, AmeriCorps) and other organizations (e.g., professional; philanthropic, religious/spiritual; community; student, social). Volunteer work helps build critical competencies, knowledge, and skills and can provide valuable training and experience that translates directly to paid employment. You will receive credit for all qualifying experience, including volunteer experience. Additional qualifications information can be found here. To qualify, applicants must have completed at least one year of specialized experience equivalent to at least the 14 grade level or above in the Federal service.  Specialized experience is defined as experience performing duties as an attorney that include: 1) preparing substantial memoranda or other legal documents; 2) conducting complex legal research; 3) orally presenting analyses, conclusions, and recommendations relating to the interpretation and application of the statutes and regulations governing financial institutions, and 4) conducting investigations and litigation (administrative or civil) involving such statutes and regulations.
