The primary purpose of this position is to serve as the senior civilian legal Attorney-Advisor to the Commander, Special Operations Command North, Peterson AFB, CO, advising on the wide range of highly political and newly emerging legal issues concerning employment of Special Operations Forces , Counterterrorism, Counter Weapons of Mass Destruction, etc. Position is also responsible for legal issues in the areas of general administrative, fiscal law, ethics, labor law, and military justice.

Duties

Serves as legal advisor for the Office of the Staff Judge Advocate with worldwide responsibilities for legal and policy guidance on SOCNORTH, USSOCOM and USNORTHCOM (hereafter referred to as the "Commands") missions in Counterterrorism (CT), Counter Weapons of Mass Destruction (CWMD), Counter Transnational Organized Crime (CTOC), Counter-narcotics (CN), homeland defense, low visibility employment of SOF, Security Cooperation, and in operations providing Defense Support to Civil Authorities (DSCA). Drafts, analyzes, and interprets legislation, executive orders, directives, and regulations governing the operations, organization, and oversight of intelligence activities in SOCNORTH and in the DoD and inter-agency intelligence community's interactions with SOF in the USNORTHCOM AOR, and worldwide as necessitated by SOCNORTH CT and CWMD missions in defense of the Homeland. As Administrative Law and Ethics Attorney, conducts legal research and renders legal opinions concerning a wide variety of matters pertaining to the interpretation and application of laws, regulations and other directives affecting the administration of operations at SOCNORTH. This legal advice spans a wide variety of legal issues across the complete range of administrative and civil law. Responsible to ensure the core classified national information protection security disciplines of information are fully covered from a policy and programmic view point to ensure overall information protection requirements meet mission requirements.

  • Position requires a Top Secret/Special Compartmented Information TS/SCI clearance based upon a Special Background Investigation (SBI). This position has recurring access to Top Secret SCI information
  • Work may often require travel away from the normal duty station on military and commercial aircraft and work overtime
  • In contingency operations, augments Battle Staff/Crisis Action Team operations will be required to work long hours in a crowded environment
  • Employee must be required to file an Office of Government Ethics (OGE) Form 450, Confidential Financial Disclosure Report, upon appointment and annually thereafter
  • In the performance of assigned duties, employee uses tact, diplomacy, and professionalism to promote effective working relationships with a variety of offices and agencies
  • Recent and significant experience (5 years relevant work experience within the past 7 years of practice) in these areas is highly preferred
  • Prior military law office experience is preferred

Qualifications

GENERAL REQUIREMENTS: You MUST have successfully completed a full course of study in a school of law accredited by the American Bar Association (ABA) and have the first professional law degree (LLB or JD). In addition, at the time of application, you must provide proof, dated within four months of application, of "active" status with a bar of the highest court of a State, U.S. commonwealth, U.S. territory, or the District of Columbia. On-line information is allowed as long as it shows that you are in "active" status. Specialized Experience: In addition to the basic requirement: you must have professional legal experience in excess of three (3) years that commensurate with the position's duties and responsibilities. KNOWLEDGE, SKILLS AND ABILITIES (KSAs): Your qualifications will be evaluated on the basis of your level of knowledge, skills, abilities and/or competencies in the following areas: 1. A law degree from an ABA accredited law school, admission to and a member in good standing of the bar of a state or the District of Columbia. Required to disclose any pending ethics or other judicial or miscellaneous allegations under review, including any adverse findings by a state bar or disciplinary committee and must consent to provide a letter for each state where admitted to demonstrate good standing. Advanced professional degree (Master of Laws, LL.M.) and/or experience in government/military administrative law, operations law, and/or intelligence law. 2. Professional knowledge of labor relation law and institution including but not limited to military and civilian personnel laws and regulations, the General Schedule Personnel System, Operations Law (Counterterrorism (ICI), Counter Weapons of Mass Destruction (CWMD), Counter Transnational Organized Crime (CTOC), Counter-narcotics (CN), Homeland Defense, low visibility employment of SOF, Security Cooperation and Defense Support to Civil Authorities (DSCA); Military Justice; Intelligence Law; and Administrative Law and Ethics. 3. Professional knowledge of Federal Government, Supreme Court decisions, federal district courts, Foreign Intelligence Surveillance Act (FISA) Court, the FISA Review Court, state courts, and the Senate Select Committee on Intelligence and the House Permanent Select Committee on Intelligence. 4. Professional knowledge of intelligence and national security law, including the National Securities Act of 1947, Executive Orders 12333 and 12958, the Foreign Intelligence Surveillance Act, the USA Patriot Act, the Freedom of Information Act FOIA), the Privacy Act (PA), national security crimes, and the policies and procedures of DoD. Incumbent must also be familiar with the policies and procedures of other intelligence agencies/activities. 5. Comprehensive knowledge of Department of Homeland Security, the National Security Council, Office of the Director of National Intelligence, the National Counterterrorism Division, FBI Weapons of Mass Destruction Division, Central Intelligence Agency, FBI Office of General Counsel, FBI Critical Incident Response Group, Department of Justice and Department of State concerning the administration and regulation of intelligence and counterintelligence operations in the United States and abroad. 6. Highly skilled in written and oral advocacy, possessing superior negotiation skills, and capable of rationale, logical thinking sufficient to prepare and present written briefs and oral arguments on behalf of SOCNORTH, to protect the interest of SOCOM, NORTHCOM, and SOCNORTH, to recognize, and analyze and segregate various legal aspects of complex factual situations, to write concise legal opinions, and to explain complex legal principles and recommend appropriate actions. Ability to plan, organize work, and direct the functions and staff of small to medium sized organization. You will receive credit for all qualifying experience, including volunteer experience. Additional Conditions of Employment: This position has been designated by the Air Force as a Testing Designated Position (TDP) under the Air Force Civilian Drug Demand Reduction Program. Employee must pass initial and periodic short notice drug testing. Illegal drug use by employees in sensitive positions presents a clear threat to the mission of the Air Force, national security, and public safety. To meet deadlines imposed by the need for resolutions to urgent legal problems involving national security and fluid real-life situations, more than a 40 hour workweek will frequently be required. Additionally, incumbent may be required to support 24/7 legal activities in operation centers during crisis response operations, contingencies and exercises as directed by Joint Staff or other agencies. During crisis operations, employee may be required to work 12 hour shifts in the command operations centers, including duty at austere deployed field locations, at the SOCNORTH JOC, or at designated alternate command locations. Employee must be graduate of a law school accredited by the American Bar Association, and be currently licensed as an attorney in active (or equivalent) status and in good standing with the bar or a U.S. State, territory, or commonwealth. Five (5) years of comprehensive experience in Domestic and International Counterterrorism, Counter Weapons of Mass Destruction, Special Operations, Intelligence Law, Counter Transnational Organized Crime, Counter-narcotics, Administrative Law, and Military Justice. Broad general law experience is highly desired.

Education

Must be a graduate of a law school accredited by the American Bar Association, and be currently licensed as an attorney, in active (or equivalent) status and in good standing, with the bar of a U.S. state, territory, or commonwealth. The attorney must maintain such bar membership in at least one jurisdiction during the entire course of employment with the Air Force.
