Duties

Acts as a legal adviser and attorney for the state/territory National Guard, responsible for the formulation of state/territory legal policy and its execution legal representation; legal initiatives; interpretation and litigation of U.S. and state/territory(s) constitutional, civil, criminal, labor law; international law and treaty agreements; trial defense; and a full spectrum of expert legal advice. Assignments include some of the most diverse, complex, difficult and emerging legal issues found in any area of law, to include: homeland security, emergency response, sovereignty, state/territory compacts, fiscal and contract law, civil affairs, employer support, military statute and administrative law (Federal & state/territory), non-military employment law (Federal & state/territory), administrative law, environmental law and emerging areas of law, i.e. domestic operations, intelligence law, weapons of mass destruction emergency response and assistance to civil authorities, etc. Responsible to advise on the legal, factual and other impacting aspects of drafting, interpretation and application of legislation, regulation, tasking orders, decision, opinions or other guiding, or lack there of, instruments associated with emerging or highly conflicted and emotionally charged issues such as intelligence oversight related to Homeland Security, or advising on Federal and state/territory Executive Orders for the use of federalized troops in response to domestic emergencies and natural disasters. These include interagency (Federal-to-Federal, Federal-to-state/territory and state/territory-to-local) homeland security & emergency management initiatives, policy, legislative proposals or implementation plans. Serves as the state/territory National Guard litigation point of contact. Represents the state/territory National Guard in all legal matters in state/territory and Federal courts of original or appellate jurisdictions. The incumbent seeks to prevent avoidable litigation, but may serve as Special Assistant to the U.S. Attorney or Assistant Attorney General at trial as cases dictate. The incumbent conducts investigations of fact and legal sufficiency; advising on administrative remedies; develops the trial strategy, content and means of presentation, and trial delivery; makes motions; and conducts post-trial duties. Prepares litigation reports, briefs, pleadings and other papers associated with litigation involving the state/territory National Guard interests. Serves as an attorney/adviser providing acquisition and fiscal legal advice to the state/territory's assigned United States Property & Fiscal Officer (the Chief of the National Guard Bureau's agent in the state/territory) and active duty military advisers. Advises Army National Guard (ARNG) and Air National Guard (ANG) contracting officers, reviews contracts, procurement actions and real property matters involving Federal and state/territory funds (some involving substantial amounts of money) for legal sufficiency, appropriate titling and claim initiation or resolution actions. Provides advice and legal assistance in bid protest matters and represents the National Guard in disputes before fiscal and contract administrative and judicial forums. Acts as the Adjutant General's representative in third-party proceedings under Federal labor-management and equal employment opportunity statutes and regulatory provisions. Represents the state/territory National Guard as a trial attorney on assigned cases before investigators, administrative judges and arbitrators from various appellate bodies including, but limited to, the Equal Employment Opportunity Commission, the Federal Labor Relations Authority, the Federal Services Impasses Panel and Federal Courts. Advises the convening authorities, including the state/territory Adjutant General, on procedural and legal issues associated with Courts Martial, Non-Judicial Punishment Administrative Board proceedings and subsequent actions. Serves as the state/territory Ethics Adviser. Reviews sensitive financial disclosure statements for General Officers and other key personnel. Provides or participates in various training activities, prepares reports and provides counsel on complex ethics issues and policies; and ensures Federal and state/territory annual administrative reporting requirements are met. Serves as claims officer for the state/territory National Guard. Reviews Claim Investigating Officer reports, adjudication recommendations, regardless of filing location, and approves forwarding of actions to the appropriate claims office. Reviews for legal sufficiency and approves or dispatches recommended action to approving authorities a variety of documents or investigative determinations such as freedom of information requests, financial liability investigations, line of duty determinations, and similar administrative proceedings. Performs other duties as required.

• Alaska Army National Guard membership is required.
• Males born after 31 December 1959 must be registered for Selective Service.
• Federal employment suitability as determined by a background investigation.

• U.S. Citizenship and Secret Clearance is required.

• APPOINTMENT FACTORS: Excepted/Officer in the Alaska Army National Guard.
• Incumbent is subject to termination due to loss or reduction in funding for this position.
• MILITARY GRADE REQUIREMENT: Due to the nature of this position, the minimum military grade is Captain (CPT/O3) and the maximum grade is Lieutenant Colonel (LTC/O5).
• MOS REQUIREMENT: Due to the nature of this position, you must currently hold the MOS of 27A.
• MILITARY EDUCATION REQUIREMENT: Due to the nature of this position, you must have completed the Officer Advanced Course. Completion of Intermediate Leadership Education (ILE) is preferred.
• Must be able to obtain and maintain the appropriate security clearance of the position.
• This position is covered by the Domestic Violence Misdemeanor Amendment (30 Sep 96) of the Gun Control Act (Lautenberg Amendment) of 1968. An individual convicted of a qualifying crime of domestic violence may not perform the duties of this position.
• Ability to establish effective professional working relationships with coworkers and customers, contributing to a cooperative working environment and successful accomplishment of the mission.
• Irregular and/or overtime (compensatory) hours may be required to support operational requirements or contingencies or may be required to work hours outside of the normal duty day.

Qualifications

SPECIALIZED EXPERIENCE is experience which is directly related to the position to be filled and which has equipped you with the particular knowledge, skills and abilities to successfully perform the duties of this position. GS-13 - Knowledge of National Guard mission, domestic operational support/support to civil authorities, contract/fiscal law, and administrative law for military operations. Experience advising senior leaders on legal sufficiency and decisional risk. Skilled in oral and written communication. Skilled in legal research and analysis, critical thinking, and complex problem solving. Experience leading a cohesive team of legal professionals. Experience advising and reviewing administrative investigations, and conducting quasi-judicial board hearings and administrative proceedings. EXPERIENCE REQUIREMENTS: Resume must have complete dates and hours worked per week for each occurrence of both civilian and military employment (Example: 2 JAN 1980 to 3 MAR 1981; 0800-1630 M-F or JAN 1980 to MAR 1981; 40 hrs/wk) Use of year only will result in disqualification. Education

Minimum Education Requirement - Must have a J.D. degree from an ABA accredited school. Must be admitted to practice before the highest court of a state, U.S. territory, the District of Columbia, or the Commonwealth of Puerto Rico. Must maintain active status as a member of the bar of one of these jurisdictions, preferably Alaska Bar Admission. NOTE: Applicants must provide a copy of their transcripts to be considered.
