The primary purpose of this position is to serve as a senior civilian attorney advisor to Headquarters First Air Force Air Force, Continental United States Region - North American Aerospace Defense Command, Air Forces Northern and Air Forces Space (CONR-1 AF (AFNORTH & AFSPACE). This position may also serve as senior legal advisor to the command in the absence of both the CONR-1AF (AFNORTH & AFSPACE) Staff Judge Advocate and the Chief, Domestic Operations and Intelligence Oversight Law.

Duties

General Civil, Administrative Law and Ethics: General Civil/Administrative law includes, but is not limited to, quality force management, standards of conduct and ethics, investigations, congressional inquiries, Freedom of Information Act (FOIA) and Privacy Act requests, regulation review and interpretation, member financial responsibility, and command authorities and responsibilities. Labor and Employment Law, Environmental Law and Litigation Support. Labor and employment law includes, but is not limited to, civilian employee discipline, workplace discrimination, union-management relations, collective bargaining, workers' compensation, unemployment compensation, affirmative action plans, and other civilian personnel issues. Contracting and Acquisition Law. Contract law includes, but is not limited to, pre and post-award contract advice, as well as advice on contractor and government procurement claims and termination actions, bid protests, bankruptcy actions, intellectual property claims, contract ratification actions, procurement fraud, non-appropriated fund instrumentalities, contractor employee issues, strategic sourcing, fiscal law, utility and housing privatization, contractor visits and capability presentations, and small business matters. Domestic Operations and Intelligence Oversight. Serves as a civilian attorney for the Office of the Judge Advocate with responsibilities for legal and policy guidance on CONR and 1 AF (AFNORTH) missions in homeland defense, homeland security, and defense support to civil authorities (DSCA). The incumbent will be an expert in National Guard duty statuses and related statutory limitations associated with utilizing those forces. Performs thorough legal research on a wide variety of complex legal issues requiring detailed investigation and analysis of Federal and state statutes, judicial opinions, and DoD Service, Coast Guard, and State Guard regulations.

  • Must have the ability to obtain and maintain a Top Secret security clearance
  • During crisis/contingency operations, employee will be required to work 12-hour shifts or longer on a 24/7 basis, in the crowded environment of the contingency action team cell and operational planning group
  • Employee must be a graduate of a law school accredited by the American Bar Association, and be currently licensed as an attorney, in active (or equivalent) status and in good standing, with the bar of a U.S. state, territory, or commonwealth
  • May be required to perform other duties as assigned in support of extended mission requirements
  • Both a scheduled and non-scheduled TDY travel may be required
  • In the absence of the SJA, the incumbent will be required to serve as the senior legal advisor to the commander
  • Employee must adhere to the Air Force Policy of Professional Responsibility Program, AFI 51-110
  • Employee may be required to file an Office of Government Ethics (OGE) Form 450, Confidential Financial Disclosure Report, upon appointment and annually thereafter

Qualifications

GENERAL REQUIREMENTS: You MUST have successfully completed a full course of study in a school of law accredited by the American Bar Association (ABA) and have the first professional law degree (LLB or JD). In addition, at the time of application, you must provide proof, dated within four months of application, of "active" status with a bar of the highest court of a State, U.S. commonwealth, U.S. territory, or the District of Columbia. On-line information is allowed as long as it shows that you are in "active" status. Specialized Experience: In addition to the basic requirement: you must have professional legal experience in excess of three (3) years that commensurate with the position's duties and responsibilities. KNOWLEDGE, SKILLS AND ABILITIES (KSAs): Your qualifications will be evaluated on the basis of your level of knowledge, skills, abilities and/or competencies in the following areas: 1. Professional knowledge of government ethics; equal opportunity and labor law, travel law, civilian personnel law, military personnel law, Constitutional law, and administrative law. Ability and advanced skill in written and oral advocacy and communicating legal information; incumbent must be skilled in conducting advanced legal research using modern methods. 2. Professional knowledge of space, land, air, and maritime laws for military defense of the homeland and knowledge of domestic operations laws associated with DSCA. Ability to mentor, train, and guide other counsel and paralegals in research, analysis, and evaluation of complex and difficult legal questions in developing appropriate and effective legal strategies; ability to liaise with external offices, agencies, and organizations to successfully present First Air Force positions, build consensus, and form effective working relationships. 3. Professional knowledge of rules, procedures, policies, and programs of a military legal office necessary to perform the procedural and administrative work of a military Staff Judge Advocate office, such as preparing and editing legal documents and administrative correspondence, maintaining files and records, and assembling information for various legal documents and reports. 4. Skill in developing strategies, and then implementing those strategies in negotiations with senior attorneys or officials at the international, federal, state, and local levels, in both the public and private sectors. 5. Ability to operate a computer and software applications relevant to legal practice. Ability to interpret and apply historical and current case law reflecting the judicial philosophy used in the interpretation and application of the law to a given set of facts and circumstances that may be highly complex and/or a case of first impression in the emerging fields of labor, employment, ethics, environmental and/or contracts and acquisition law. 6. Ability to recognize, analyze, and review proposed agency settlement policies and procedures to improve those policies and procedures, ultimately reducing government liability for discrimination and improving state compliance with nondiscrimination in the workplace. PART-TIME OR UNPAID EXPERIENCE: Credit will be given for appropriate unpaid and or part-time work. VOLUNTEER WORK EXPERIENCE: Refers to paid and unpaid experience, including volunteer work done through National Service Programs (i.e., Peace Corps, AmeriCorps) and other organizations (e.g., professional; philanthropic; religious; spiritual; community; student and social). Volunteer work helps build critical competencies, knowledge and skills that can provide valuable training and experience that translates directly to paid employment. You will receive credit for all qualifying experience, including volunteer experience. Additional Conditions of Employment: To meet deadlines imposed by the need for resolutions to urgent legal problems involving national security and fluid real-life situations, more than a 40-hour work week to include weekend work may occasionally be required. This is a Mission Essential (ME) position performing a Mission Critical Function (MCF) which must continue uninterrupted after the occurrence of an emergency and continued through full resumption of all functions. IAW, DoDI 3020-42, Defense Continuity Programs. This position is designated as a key position IAW AFI 36-507. Duties of this position are essential to the accomplishment of wartime/contingency operations. Incumbents of key positions must be removed from their military recall status if alternative for filling of the position during an emergency are not available. This position has been designated by the Air Force as a Testing Designated Position (TDP) under the Air Force Civilian Drug Demand Reduction Program. Employee must pass initial and periodic short notice drug testing. Illegal drug use by employees in sensitive positions presents a clear threat to the mission of the Air Force, national security, and public safety.

Education

Must be a graduate of a law school accredited by the American Bar Association, and be currently licensed as an attorney, in active (or equivalent) status and in good standing, with the bar of a U.S. state, territory, or commonwealth. The attorney must maintain such bar membership in at least one jurisdiction during the entire course of employment with the Air Force.
