This position is located in the Office of the Solicitor, San Francisco Regional Office. Regional staff render legal advisory services to Department of Labor client agencies as well as engage in enforcement litigation. The SOL Regional Offices have responsibility for the trial of all civil litigation in U.S. District Courts and for administrative proceedings before Administrative Law Judges This position is outside the bargaining unit.
Duties
Prepares and organizes exhibits, electronic and paper case files, correspondence, and records. Discards electronic and paper files pursuant to retention policies.
Prepares and reviews legal documents for content, legal sufficiency, and administrative accuracy. Gathers necessary information and data, performs legal research required, and composes necessary pleadings or draft responses for use by attorney. Determines what further facts and legal sources are applicable; contacts witnesses and obtains other statistical or documentary evidence. Verifies citations and legal authorities. Summarizes findings or documents for use by attorneys in preparing legal documents.
Maintains court calendars and negotiates calendar status with counsel and court personnel.
Research legal issues and legal precedents. Analyzes their appropriateness and applicability to respective programs for which the office is responsible.
Contributes to the internal management of legal functions and office management as needed. Identifies the need for uniform procedures and standards to facilitate legal activities and related administrative processes and avoid duplication of effort and undue delay in accomplishing objectives. Recommend and participate in the implementation of improved procedures.
Performs legal assistant duties that provide supporting assistance such as the copying and preparation of legal documents; completing logs, charts and other legal documents; tracking documents through the legal process to ensure that critical dates are met, the preparation of correspondence in support of the attorneys and other SOL staff, and the entry and tracking of cases in SOL databases.
Assists attorneys in Merit System Protection Board, Equal Employment Opportunity, and arbitrations hearings. Participates in interviewing potential witnesses, union representatives, claimants, grievant, and employees to gather information and arranging for subpoenas and indexing/abstracting depositions.
Arranges for the issuance of subpoenas, requests for administrative subpoenas, payment of witness and travel fees, taking of depositions, arrangements for court reporters to take depositions, preparation of notice to take depositions, etc.
Identifies the need for uniform procedures and standards to facilitate legal activities and related administrative processes and avoid duplication of effort and undue delay in accomplishing objectives. Recommend and participate in the implementation of improved procedures. As requested, works with Management Analysts and other staff to maintain, track, and prepare all reports regarding Regional property and coordinates with Regional OASAM and MALS regarding Regional property. Ensures that supplies are maintained, and equipment is serviced.
Prepares status and statistical reports relevant to cases and program activities of the office and other correspondence and notes and corrects case file deficiencies (e.g., missing documents, inconsistent material, leads not investigated) before sending the case to the concerned trial attorney. Prepares and maintains summary records/digests for office programs.
The incumbent is responsible for ordering and maintaining subscriptions, E-Filing, and responding to the Freedom of Information Act (FOIA) requests and requests for agency testimony and record in third party actions (Third Party Subpoena cases).
Requirements
- Must be a U.S. Citizen.
- Must be at least 16 years old.
- Candidate required to obtain the necessary security/investigation level.
- Requires a probationary period if the requirement has not been met.

For GS-09: Applicants must have 52 weeks of specialized experience equivalent to at least the next lower grade level GS-07 in the Federal Service.
Specialized Experience is the experience that equipped the applicant with the particular knowledge, skills, and abilities (KSA's) to perform the duties of the position successfully, and that is typically in or related to the position to be filled. To be creditable, specialized experience must have been equivalent to at least the next lower grade level.
Qualifying specialized experience for GS-09 includes performing majority: (1). Utilizing principles, concepts, and methods of legal research and analysis to perform recurring case development and documentation assignments which are typically covered by established precedents; (2). Gather and analyze data and to evaluate its usefulness in resolving legal issues; (3). Interview potential witnesses, industry and union representatives, workers, and other sources of information, and skill in developing evidence to support the agency's litigation activities; (4). communicate effectively orally and in writing in order to convey research findings to attorneys and other parties, and obtain information.
Full Promotion Potential: The full performance level of this position is a GS-11.
