The Investigator position provides direct support and assistance to higher level investigators and managers. This position is responsible for planning, directing, and administering a program of enforcement to ensure maximum compliance with the Employee Retirement Income Security Act of 1974 (ERISA) and the criminal provisions of the United States Code as they relate to employee benefit plans. This position is outside the bargaining unit.

Duties

Major duties include but are not limited to: Serve as a technical expert and program advisor regarding the planning, development, implementation, and evaluation of current and proposed goals, objectives, and strategies about the EBSA health, pension or criminal investigations, the enforcement program, education, and compliance. Provide insight and guidance regarding the interpretation and implementation of EBSA's statutory responsibilities under the criminal provisions of Title I of ERISA; Title 18 United States Criminal Code; and other related laws. Recommend significant policy and program change that targets criteria, and enforcement and initiatives which address EBSA objectives and industry trends and problems. Formulate, recommend, and oversee the implementation of the strategies, methodologies, targeted criteria, procedures, reporting and accountability systems, and guidance that form the basis for the EBSA enforcement program. Keep well informed on current trends, interpretations, and legal actions arising from cases that may affect the enforcement of the provisions of ERISA. Coordinate enforcement efforts to ensure a comprehensive enforcement presence across the country. Initiate and maintain intra- Department, interagency, and intergovernmental liaison to assure coordination of Department, Federal and State programs aimed at compliance with ERISA and other Federal statutes related to employee pension and welfare benefit plans. Assist management when representing EBSA and DOL at conferences, with other Federal, State, and local agencies. Clarify and resolve questions of jurisdiction, policy, and strategy; formulate interagency teams to conduct joint investigations; jointly formulate investigative priorities and initiatives; discuss resolution of precedential and national enforcement problems enforcement efforts; discuss improvement of enforcement efforts and methodologies; participate in and/or lead interagency enforcement training efforts.

Requirements

  • Must be a U.S. Citizen.
  • Must be at least 16 years old.
  • Candidate required to obtain the necessary security/investigation level.
  • Requires a probationary period if the requirement has not been met.

Qualifications

You must meet the Specialized Experience to qualify for Employee Benefits Investigator, as described below. For GS-14: Applicants must have 52 weeks of specialized experience equivalent to at least the next lower grade level (GS-13) in the Federal Service. Specialized Experience is the experience that equipped the applicant with the particular knowledge, skills, and abilities (KSA's) to perform the duties of the position successfully, and that is typically in or related to the position to be filled. To be creditable, specialized experience must have been equivalent to at least the next lower grade level. Qualifying specialized experience for this position includes: Experience with programs, priorities and the civil laws administered by Federal and State agencies which impact health benefit plan activities and health coverage; Experience with the health benefit industry, benefit claims processing, investigative methodology, auditing and accounting systems; Experience with regulatory requirements and sub-regulatory guidance of Employee Retirement Income Security Act (ERISA) including the group health plan requirements under part 7 as amended by HIPAA, MHPA, MHPAEA, WHRCA, Newborn's Act, GINA, Michelle's Law, CHIPRA and the Affordable Care Act; Experience analyzing and measuring the effectiveness and efficiency of the health enforcement programs.

Education

There is no substitute of education for specialized experience to qualify for this position.
