THIS IS A NATIONAL GUARD TITLE 32 EXCEPTED SERVICE POSITION THAT REQUIRES MILITARY MEMBERSHIP. This National Guard position is for a PARALEGAL SPECIALIST, Position Description Number PDD2416000 and is part of the Mississippi National Guard.

Duties

As a PARALEGAL SPECIALIST, GS-0950-11, you will provide Paralegal support within the state/territory Staff Judge Advocate's Office providing ancillary legal research and analysis. Manages the Freedom of Information Act (FOIA), Preventative Law and Alternative Dispute Resolution (ADR) programs in the state/territory. Serves as a point of contact for claims, ethics determinations, legal assistance for Army and Air National Guard personnel and their families, and provides technical legal guidance and support to National Guard unit commanders and their assigned legal personnel. MAJOR DUTIES: 1. Advises the Staff Judge Advocate on all command issues on behalf of command staff, researching interpretation of federal/state statutes and regulations, and ensuring that legal guidance and support is furnished in a timely manner. Advises Wing leadership on options, which are legally permissible, or desirable, after consultation with the SJA. Prepares, researches, and drafts written legal opinions after SJA review with regard to applicable laws, regulations, instructions, directives, and policies in the area of Administrative Law including, but not limited to: Reports of Survey; Line of Duty Determinations; formal and informal investigations and commander inquiries; legal sufficiency reviews; Inspector General and Equal Employment Opportunity investigations; fiscal law; unfavorable personnel actions; standards of conduct; family advocacy; and public relations. 2. Provides legal assistance on a non-interference basis to members of the ANG and their dependents as authorized by AFI 51-504, CNGBI, NGR, and other AF/JA guidance. As resources and expertise permit, legal assistance may also be provided to Active Component members, or other Reserve Component members, and retirees of any military service. In line with professional responsibility standards, legal assistance with respect to the following legal matters may be provided to eligible beneficiaries with the supervision of the SJA, or draft opinions/documents for the SJA to execute thereof: wills, powers of attorney, living wills and health care directives, notary services, dependent care plans, casualty affairs (death incident to the performance of military duty), employment problems arising from the performance of military duty and subject to the Uniformed Services Employment and Reemployment Rights Act (USERRA) or a similar state statute, land-lord tenant problems specifically related to performance of military duty, tax problems specifically related to performance of military duty, matters arising from the performance of military duty and subject to the Service members Civil Relief Act (SCRA), or a similar state statute, providing Special Victim's Counsel (SVC) services, or area defense counsel services, when necessary. 3. Conducts legal research of federal and state/territory code, regulations, policies, procedures, case law, legal and administrative decisions and opinions, and summarizes findings to aid the SJA in case or project resolution. Research is performed on a variety of legal subjects including, but not limited to: federal and state/territory code, legislative proposals or intent, military justice and status issues for T10 and T32 members, claims, labor relations, equal opportunity, administrative actions, contractual agreements, ethics, environmental concerns, law enforcement, bankruptcy, taxation, legal assistance, and a wide variety of miscellaneous legal issues. Provides extensive litigation support to Wing Staff Judge Advocates for cases held before the FLRA, EEOC, and MSPB. Interviews clients and potential witnesses, collects and organizes pertinent factual and research material to build case files, and prepares and organizes exhibits. 4. Provides research, analysis, guidance, and support to administer courts-martial, non-judicial punishment, administrative boards and other legal actions and administrative processes. Reviews procedures, timing criteria and documents relative to the administration of justice under the Uniform Code of Military Justice and associated state/territory code. Performs research to identify factual and legal issues to uncover relevant information for summaries of precedent cases, interviews, testimony, depositions, and related case material for use by the attorneys. Performs research and preparation of notes and memoranda regarding allegations and possible charges, maintains logs and files, and files motions. 5. Serves as the primary point of contact for ethical determinations. Screens requests for ethics opinions and gathers the applicable facts. Analyzes the specifics of each situation. Conducts legal research and applies cumulative knowledge to the factual element and recommends a course of action or refers that recommendation to the SJA. Assists the Staff Judge Advocate with implementation of the joint ethics regulatory annual reporting requirements. 6. Performs other duties as assigned.

This is an indefinite position, tenure 3, with a time limit determined by the needs of the agency. Any permanent military technician who is selected for this position will become tenure 3. The selectee will receive the same benefits and entitlements as the tenure 1 employee, but will be considered tenure 3 for purposes of reduction in force. You can be terminated at any time with a 30-day notice. If a permanent resource becomes available, incumbent may be converted to a permanent appointment without competition. NATIONAL GUARD MEMBERSHIP IS REQUIRED: This is an excepted service position that requires membership in a compatible military assignment in the National Guard. Selectee will be required to wear the military uniform. Acceptance of an excepted service position constitutes concurrence with these requirements as a condition of employment. MILITARY MEMBERS WITH BONUSES: Upon acceptance of a military technician position military members who are currently receiving a military Reenlistment/Extension Bonus (REB) or GI Bill-SR Kicker may lose incentive eligibility and may be subject to termination or suspension of incentive (includes indefinite and temporary technicians on assignment for more than 180 days in any continuous 12-month period). GENERAL EXPERIENCE: Experience, education or training that demonstrates the ability to analyze the legal impact of legislative developments and administrate and judicial decisions, opinions, rulings and determinations on agency programs; conduct research for the preparation of legal opinions on matters of interest to the agency. SPECIALIZED EXPERIENCE: Must have at least 36 months experience, education or training in the formal and informal rules of evidence and skill necessary to evaluate the adequacy and/or admissibility of evidence, to request additional data or further investigation, when needed, or to develop narrative or graphic exhibits to support specified legal arguments and coordinate actions with other federal agencies or state and local jurisdictions that have closely related responsibilities.
