The primary purpose of this position is: To provide expert legal representation to eligible victims of qualifying offenses seeking relief from appellate courts and through parole and clemency processes; to provide post-trial legal assistance; to develop and execute training for victims' counsel and paralegals; to develop and execute the NG Special Victims' Counsel Program's policy mission.

Duties

Represents NG SVC Program on post-trial parole and clemency matters, and post-trial legal assistance. Oversees the representation of clients whose cases are progressing through the post-trial appellate process, including military parole, clemency proceedings, and clients petitioning for extraordinary relief. Incumbent personally represents clients during these proceedings and assigns clients to other attorneys, as appropriate and in coordination with the NG SVC Program Manager. Develops and execute NG SVC Program's policy mission. In coordination with NG SV Program Manager, based on appellate cases and knowledge, develops policy guidance concerning the Special Victims' Counsel Program. Supports in the performance of legal research and drafting of amendments, as necessary, the Chief National Guard Bureau's Manuals and Instructions, and assists in preparation and review of draft policy/operating procedures that impact the NG SVC Program. Develops and executes training for NG SVC Program personnel, stakeholders and sister-service victims' counsel, as appropriate. In coordination with NG SV Program Manager, based on appellate cases and knowledge, develops curricula and blocks of instruction, as assigned, for NG SVC Program controlled training events, to include identifying internal and external speakers.

  • Attorney appointments are subject to serve a one-year probationary period.
  • Candidates are not required to have active duty service or veterans’ preference to be referred and considered. All qualified candidates who meet the recruitment assessment criteria will be referred to the selecting official.
  • Employee must be a graduate of a law school accredited by the American Bar Association, and be currently licensed as an attorney, in active (or equivalent) status and in good standing, with the bar of a U.S. state, territory, or commonwealth.
  • Employee must adhere to the Air Force and Army Rules of Professional Conduct (AFI 51-110 and AR 27-26)
  • Employee must be able to obtain and maintain an appropriate security clearance
  • Employee may be required to work overtime.
  • Work requires significant (at least 25%) temporary duty travel away from the normal duty station on military or commercial aircraft.
  • Employee may be required to file an Office of Government Ethics (OGE) Form 450, Confidential Financial Disclosure Report, upon appointment and annually thereafter.
  • At least 3 years of related experience, a Master of Laws (LLM) in a related field will count for (1) year of experience

Qualifications

GENERAL REQUIREMENTS: You MUST have successfully completed a full course of study in a school of law accredited by the American Bar Association (ABA) and have the first professional law degree (LLB or JD). In addition, at the time of application, you must provide proof, dated within four months of application, of "active" status with a bar of the highest court of a State, U.S. commonwealth, U.S. territory, or the District of Columbia. On-line information is allowed as long as it shows that you are in "active" status. Specialized Experience: In addition to the basic requirement: you must have professional legal experience in excess of three (3) years that commensurate with the position's duties and responsibilities. KNOWLEDGE, SKILLS AND ABILITIES (KSAs): Your qualifications will be evaluated on the basis of your level of knowledge, skills, abilities and/or competencies in the following areas: 1. In-depth knowledge of applicable law pertaining to the specialized areas of legal practice in order to provide education to command and management. Sufficient knowledge of federal, state, and local law, as it affects the private individual, to provide personal legal assistance to eligible beneficiaries across the typical range of the NG-SVC practice. 2. In-depth knowledge of the Uniform Code of Military Justice, the Manual for Courts-Martial, the Rules for CourtMartial, the Military Rules of Evidence, DA-PAM 27-9 (Military Judge's Bench book), and other legal references relating to the military justice process. Versatile in all statutes, directives, instructions, regulations, and procedures that impact the National Guard, Army, and Air Force SAPR programs. 3. In-depth knowledge of military appellate practice, to include petition for extraordinary relief, interlocutory appeals, and appellate procedure. In-depth knowledge of the DoD Sexual Assault Prevention and Response program and victims' rights, including need for sensitivity and confidentiality in sexual assault and domestic violence cases. In-depth knowledge of military justice practice and procedure, including trial practice and procedure. Knowledge of all applicable Air Force Instructions, Army Regulations and NGB policies that pertain to sexual assault, sexual harassment and domestic violence, including line of duty, medical board processes, VA processes, and board of corrections processes and procedures. In-depth knowledge and experience of providing instruction to course or conference attendees in policy, programs, and military justice issues. 4. Broad, current knowledge of DoD, National Guard, Army and Air Force organizations, functions, authorities, and lines of command. Knowledge must cut across the entire spectrum of DoD, National Guard, Army and Air Force programs, operations, and management. 5. Skill in performing legal research using electronic and traditional methods. Skill in recognizing and analyzing key legal issues in a factual situation and applying well-reasoned analysis to make arguments and reach clear, concise conclusions. Skill in communicating complex legal issues clearly, concisely, and effectively, both orally and in writing. 6. Ability to analyze complaints to identify relevant issues, to analyze evidence, and to draw sound conclusions to make appropriate recommendations. Ability to research legal issues, analyze complex factual situations in light of general legal principles and prepare written legal opinions. Ability to work independently with minimal supervision and guidance and to meet established schedules for on-going projects and short-notice suspense's. Ability to communicate effectively with a diverse group of individuals, in and outside the legal profession, both orally and in writing, in formal and informal settings. PART-TIME OR UNPAID EXPERIENCE: Credit will be given for appropriate unpaid and or part-time work. You must clearly identify the duties and responsibilities in each position held and the total number of hours per week. VOLUNTEER WORK EXPERIENCE: Refers to paid and unpaid experience, including volunteer work done through National Service Programs (i.e., Peace Corps, AmeriCorps) and other organizations (e.g., professional; philanthropic; religious; spiritual; community; student and social). Volunteer work helps build critical competencies, knowledge and skills that can provide valuable training and experience that translates directly to paid employment. You will receive credit for all qualifying experience, including volunteer experience. ADDITIONAL CONDITIONS OF EMPLOYMENT: If not previously completed at the Army Judge Advocate General's Legal Center and School, the Air Force Judge Advocate General's School, or the Naval Justice School, employee must complete required initial victim counsel training course(s) to include training on domestic violence and representing child victims within 9 months of appointment. Employee must be able to obtain and maintain designation and certification as competent as a Special Victims Counsel under 10 U.S. Code § 1044e(d), including being certified under 10 U.S.C. § 827, within 6 months of appointment, unless a waiver for up to an additional 5 months is granted by the Program Manager of the National Guard Special Victims' Counsel Program.

Education

Must be a graduate of a law school accredited by the American Bar Association, and be currently licensed as an attorney, in active (or equivalent) status and in good standing, with the bar of a U.S. state, territory, or commonwealth. The attorney must maintain such bar membership in at least one jurisdiction during the entire course of employment with the Air Force.
