The Supervisory Wage and Hour Investigator (Director of Enforcement) oversees the enforcement activities of the District Offices in the WHD Region that are responsible for conducting investigations of businesses to ensure compliance with all of the laws that WHD is responsible for enforcing. This position is outside the bargaining unit.

Duties

The Wage and Hour Division (WHD) is an essential labor law enforcement agency responsible for enforcing significant labor laws affecting nearly 150 million workers. Our mission is to protect rights related to minimum wage, overtime, child labor, family and medical leave, employment conditions for migrant workers, lie detector tests, garnishments, prevailing wages on government-funded contracts, labor provisions of several guest worker programs, and more. As the Supervisory Wage and Hour Investigator (Director of Enforcement) assigned to the Chicago Regional Office, you will perform the following duties which are not all-inclusive: Oversees the enforcement activities of the District Offices in the Region and the development of integrated plans, local policies, strategies, guidelines, systems and procedures for the conduct of Wage and Hour program activities in the region. Reviews sensitive and confidential investigation case files from the district offices to ensure conformance with established regulations, policies and priorities. Represents the Regional Office in settlement conferences and trials which flow from the referral of cases for litigation. Coordinates program activities with related activities of other Department of Labor, State and other Federal enforcement agencies as they pertain to worker protection laws administered by the Wage and Hour Division. Identify potential litigation cases and works closely with representatives of the Solicitor's Office and/or Assistant U.S. Attorney in building the most effective case where litigation is involved. Provides technical advice and assistance to Northeast Region Managers, Regional Enforcement Coordinators, Investigators and Technicians on cases in which targeted industry enforcement precedents are not applicable, evidence is inconclusive, and issues are ambiguous. Research statues, regulations, interpretive bulletins, opinion letters, court cases and other available source materials to obtain answers to technical questions raised in the course of investigations or by written inquiry from the public. Advises the Directors of the District Offices on a variety of matters, including the assessment of liquidated damages in FLSA cases, the assessment and negotiation of civil monetary penalties and interpretations of the statutes and regulations enforced by WHD. Supervises the Deputy Director of Enforcement and a team of Regional Enforcement Coordinators to direct, coordinate, and oversee the Region's enforcement program.

Qualifications

You must meet the requirements listed below to qualify for the Supervisory Wage and Hour Investigator (Director of Enforcement) You must meet the following Individual Occupational Requirements (IOR) and the Specialized Experience to qualify for Supervisory Wage and Hour Investigator (Director of Enforcement) 1. Applicants must meet at least TWO of the following THREE specialized criteria requirements: General knowledge of Federal wage and hour labor laws, industrial occupations, wage scales, employment practices, or salary and wage administration practices. Skill in analyzing written/verbal information and numerical data and making decisions on issues based on interviews, records review, reconstruction of missing or fraudulent records and applying legal or regulatory provisions, precedents, and principles to specific investigative matters. Skill in personal contacts requiring the ability to explain requirements or rights and obtain information and cooperation from people with diverse backgrounds and levels of understanding, reconcile conflicting interests, and persuade others to comply voluntarily with requirements. 2. In addition to the criteria specified above, applicants must have knowledge of and ability to apply the provisions of Federal wage and hour labor laws pertaining to wages, hours of work, or related conditions of employment. Examples of qualifying specialized experience include: Developing, interpreting, or applying policies, procedures, and operating standards in determining compliance for an organization or government-based program. Conducting interviews and providing information about laws and/or regulations. Industrial personnel or salary and wage administration or responsible work in a certified public accounting firm. Analyzing or applying labor legislation. Reviewing and evaluating operations and procedures through analysis, audits, or surveillance inspections. Federal, State, or self-regulatory agency work involving obtaining compliance with appropriate program requirements. AND 3. Applicants must possess 52 weeks at the GS-13 grade level of the following specialized experience: Experience influencing and negotiating with external organizations to gain compliance with wage and hour laws and penalties. Experience interpreting and utilizing Wage and Hour Laws and Regulations and Field Operations Handbook to provide input for policy development and changes. Experience in preparing responses to non-routine inquiries from employers, employees, unions, business associations, State and Local government officials, and members of Congress throughout the Region concerning program enforcement, policy guidelines, and interpretations. Experience communicating with high level internal and external representatives to provide technical information concerning the requirements, interpretations and application of the laws enforced by Wage and Hour Division. Applicants must meet the eligibility requirements of time-in-grade (52 weeks at the GS-13 grade level or equivalent in the Federal Service), time-after-competitive-appointment (90 days, if applicable), and minimum qualifications.
