These positions are located in the Office of the Deputy Secretary, Office of Administrative Law Judges (OALJ). These offices are responsible for conducting adjudicatory hearings and issuing decisions for the Department of Labor under more than 70 different laws and executive orders. Current OALJ telework policy requires this position to be in office at all locations for at least 5 days per two-week pay period. Please see Additional Information for Salary Ranges Per location.

Duties

Applicants may only select a maximum of 3 out the 8 locations for consideration. Upon case assignment, studies and analyzes the case file. Conducts a detailed analysis of the factual and legal issues presented in the case file. Conducts legal research for cases and analyzes and studies the statutes, executive orders, regulations, and rules applicable to the cases heard by OALJ, the Rules of Administrative Procedure, and the Federal Rules of Evidence. Anticipates issues which may arise at the hearings or which should be raised. On own determination or as requested by the ALJ, develops and prepares complex orders that require legal research and discussions of points of law, responds to motions or pleadings to compel discovery, and otherwise prepares the cases for hearing. Draft responses to pre and post-hearing motions. Prepares pre-hearing synopses and/or reports of cases that set forth the facts and issues in the case; the procedural history of the case; the medical and other evidence presented, the conflicts in the evidence, and evidence which needs further clarification; the employment record of the claimants; pleadings; issues in the case; and provisions of the laws related to the case and case law and its interpretation, which may be germane to the case. Carries out other duties to prepare cases for hearing. Confers with and responds to questions and correspondence from attorneys on procedural and legal aspects of the case. Confers with the ALJ and provides legal advice on cases and points of law. The work often requires extended and detailed consultation on the legal issues involved, presentation of the facts related to legal issues, evaluation of conflicting evidence and facts and weighing the facts, consideration of the inferences to be drawn, and examination of the effect of a particular decision and its relationship to case law and interpretations made by Boards and the Courts.

Qualifications

To qualify for an attorney position, applicants must possess a professional law degree (LL.B. or J.D.) with a preference that applicants have graduated in the top half of their Law School Class. Successful applicants would have excellent legal research and writing skills which may be demonstrated through law review, moot court, or as a research assistant. Applicants also must supply the following documents below. Bar Certificate: be a member in good standing of the bar of a court of general jurisdiction of a state, territory or possession of the U.S. Transcripts: You must provide a copy of your law school transcript to be considered for this position. Verification of your academic degree(s) is necessary to determine your qualifications or eligibility for this position, you will be required to submit an official transcript for verification purposes before you are hired. However, unofficial transcripts may be submitted during the application phase of the process. Please note that your J.D. or LL. B degree must be conferred before you can begin working. Writing Sample: In addition to your transcripts applicants must also provide an unedited legal writing sample that is no more than ten (10) pages long with your application in order to receive further consideration.

Education

A LL.B or J.D. is a requirement for this position. If you do not submit sufficient academic documentation necessary to demonstrate that you meet the eligibility and minimum qualification requirements described in this announcement, your application will be deemed incomplete and you will be ineligible for further consideration for this vacancy.
