The incumbent serves as the principal advisor in the area of Equal Employment Opportunity (EEO), Affirmative Employment, the Civil Rights External Programs, & Alternative Dispute Resolution (ADR) Supervisor for VA Ann Arbor Healthcare System. The incumbent is responsible to the medical center director for program development, administration, evaluation and advisory functions.

Duties

Major Duties and Responsibilities: EEO Program Management- The incumbent must exercise a high degree of judgment in analyzing and recommending solutions to problems that adversely affect EEO and Affirmative Employment. A high degree of judgment must be exercised in establishing priorities and direction for the program for maximum results. The incumbent advises management on specific actions in support of affirmative action, and strategies for handling discrimination complaints. The incumbent assists the Office of Resolution Management and Administrative Judges with investigations and hearings. In collaboration with the Office of Resolution Management (ORM) Field Office, the incumbent serves as the local liaison for all aspects of the facility's complaint processing program. This includes assistance to ORM field office personnel during both the counseling and investigative stages. Such involvement includes providing documentation as requested; locating and identifying employees involved in the complaint process; discussing resolution efforts, negotiating settlements, and drafting same on behalf of management. The incumbent also provides advice and assistance during the post-investigative stages for each formal complaint. This includes working with EEOC Administrative Judges, Regional Counsel Staff, Office of General Counsel, Office of Employment Discrimination Complaint Adjudication, as well as local supervisors and managers. The incumbent serves as technical expert for processing the following federally conducted external complaints in accordance with agency policy; complaints are not processed by ORM. The incumbent assists VHA Central Office and Medical Center Staff with processing complaints. Develops an Alternative Dispute Resolution (ADR) Program, which is any procedure or combination of procedures voluntarily used to resolve issues in controversy without the need to resort to litigation. These procedures include, but are not limited to, assisted settlement negotiations, conciliation, facilitation, mediation, fact-finding, mini-trials, and arbitration, that require an impartial advisor or neutral third party. As the facility's program manager, will attempt, through reviews and discussions with both parties, to assist in negotiating a settlement. As program manager, will assist the parties to: structure the negotiation; clarify the core issues in dispute; avoid personality conflicts that disrupt the negotiation; identify the strengths and weaknesses of each person's position; and examine alternative approaches, which facilitate a compromised agreement. Supervision/Managerial Responsibilities- The incumbent provides technical and administrative supervision to a unit of up to three staff which include the positions of EEO Specialist (GS-0260-11), EEO Specialist (GS-0260-11), and EEO Specialist (TCF Intern) (GS-0260-09/11). The incumbent oversees the daily operation of the EEO and other associated programs, ensures that agency policies and priorities are being followed, develops performance standards, and evaluates work performance of subordinates. The incumbent gives advice, counsel, and instruction to employees on both work and administrative matters. The incumbent hears and resolves minor complaints from employees, refers group grievances and more serious unresolved complaints to a higher-level supervisor or manager, effects minor disciplinary measures such as warnings and reprimands and recommends action in more serious cases. The incumbent interviews candidates for positions in the unit, recommends appointments, promotions, and reassignments to unit positions, identifies and provides for training needs, and finds ways to improve production or increase the quality of work within the area of authority. Incumbent establishes short and long-term priorities, performance measures, and individual development plans and performance appraisals for staff. Incumbent is responsible for all human resources, budget management, financial management, property management, procurement and acquisition, time and attendance, and all associated administrative functions for the effective operation of the Diversity and Inclusion (D&I) program. Recommends the levels of staffing and funds to be devoted to the program. Work Schedule: 8:00 am to 4:30 pm, Monday through Friday Telework: VA supports the use of telework as a way to help attract and retain talented individuals in public service, increase worker productivity, and better prepare the agency to operate during emergencies. To qualify for this position, applicants must meet all requirements by the closing date of this announcement, 01/15/2024. Time-In-Grade Requirement: Applicants who are current Federal employees and have held a GS grade any time in the past 52 weeks must also meet time-in-grade requirements by the closing date of this announcement. For a GS-12 position you must have served 52 weeks at the GS-11. The grade may have been in any occupation, but must have been held in the Federal service. Note: You must submit a copy of your most recent personnel action/SF50. Additionally, An SF-50 that shows your time-in-grade eligibility must be submitted with your application materials. If the most recent SF-50 has an effective date within the past year, it may not clearly demonstrate you possess one-year time-in-grade, as required by the announcement. In this instance, you must provide an additional SF-50 that clearly demonstrates one-year time-in-grade. You may qualify based on your experience as described below: Specialized Experience: You must have one year of specialized experience equivalent to at least the next lower grade GS-11 in the normal line of progression for the occupation in the organization. Examples of specialized experience would typically include, but are not limited to: Extensive knowledge of Federal EEO laws, regulations, Executive Orders, policies and principles governing Federal EEO, Diversity and Inclusion (D&I), & Alternative Dispute Resolution (ADR) practices. Knowledge and skills sufficient to plan, organize, direct, staff, carry out, and evaluate an equal employment opportunity program that, in addition to meeting basic regulatory requirements, focuses on the solution of systemic problems, elimination of barriers to equal employment including agency management policies and practices, and provision of management advisory and consulting services designed to effect major changes is essential. Broad and in-depth knowledge, advanced skill, and demonstrated competency in human resource management principles, equal employment opportunity and diversity and inclusion management practices sufficient to plan, direct and evaluate the agency's outreach and retention programs, policies, and reports.
