THIS IS A NATIONAL GUARD TITLE 5 EXCEPTED SERVICE (INDEFINITE) POSITION.
This National Guard position is for a Attorney-Advisor (General), Position Description Number NGT0097000 and is part of the Guam Joint Force HQ Command, National Guard.
Duties
1. Acts as a legal adviser and attorney for the state/territory National Guard, responsible for the formulation of state/territory legal policy and its execution legal representation; legal initiatives; interpretation and litigation of U.S. and state/territory(s) constitutional, civil, criminal, labor law; international law and treaty agreements; and a full spectrum of expert legal advice. Acts as a legal adviser and attorney for the state/territory National Guard, responsible for assisting in the formulation of state/territory legal policy pertaining to prevention of sexual assault, sexual harassment, and domestic abuse, while serving as the special legal advisor to the Adjutant General, the Office of Staff Judge Advocate (OSJA), Commands SHARP and SEEM programs. Primary coordinator and advisor in the OSJA pertaining to military justice/adverse actions that are initiated against alleged offenders. Serves as the primary point of contact for outside entities and stakeholders, including Special Victims' Counsel, Defense Services, the SARC and the SEEM Manager preventing future harm to victims by ensuring the proper procedures are implemented and followed and that justice and adverse actions are administered properly. Counsel provided covers the full spectrum of legal and organizational concerns, frequently involving the most politically and legally substantive, sensitive, and privileged issues faced by senior public sector leaders. (20%)
2. Responsible to advise on the legal, factual, and other impacting aspects of drafting, interpretation and application of legislation, regulation, tasking orders, decision, opinions or other guiding, or lack thereof, instruments associated with emerging or highly conflicted, sensitive and emotionally charged issues relating to sexual crimes, harassment, domestic violence/abuse, and to the prevention and response of sexual crimes, harassment, and domestic violence/abuse. Conducts outreach on behalf of the organization to legal entities and organizations, including State Bar, and statewide civilian organizations who support victims, and conducts training to the organization and leaders regarding legalities/requirements in addressing prevention and response of special crimes, domestic violence, and sexual assault. Serves as legal counsel and advises on any legislation, policy, or guidance providing for an authorization and funding for NGB to conduct recurring National Guard unit inspections and staff assistance visits for prevention and oversight of sex crimes, harassment, and domestic violence/abuse. Advises Adjutant General and Commanders on any legislation, laws, policy, or guidance related to victims' rights or survivor facilitation and healing, including but not limited to Crime Victims' Rights Act (CVRA), Article b6 of UCMJ, and the "No Wrong Door" approach. 3. Serves as the state/territory National Guard litigation point of contact. Represents the state/territory National Guard in all legal matters in state/territory of original or appellate jurisdictions, to include matters pertaining to sexual crimes, sexual harassment, and domestic violence/abuse. The incumbent seeks to prevent avoidable litigation but may serve as Special Assistant to the U.S. Attorney or Assistant Attorney General at trial as cases dictate. Except for sexual assault and sexual harassment investigations (as prohibited by relevant law), the incumbent conducts investigations of fact and legal sufficiency; advising on administrative remedies; develops the trial strategy, content and means of presentation, and trial delivery; makes motions; and conducts post-trial duties. (20%)
4. Serves as an attorney/adviser providing acquisition and fiscal legal advice to the state/territory's assigned United States Property & Fiscal Officer, particularly in the area of emerging requirements in victim support and legal resourcing (the Chief of the National Guard Bureau's agent in the state/territory) and active-duty military advisers. (20%)
5. Acts as the Adjutant General's representative in third-party proceedings under Federal labor management and equal employment opportunity statutes and regulatory provisions. Represents the state/territory National Guard as a trial attorney on all sexual assault, sexual harassment and domestic violence cases, administrative judges and arbitrators from various appellate bodies including, but limited to, the Equal Employment Opportunity Commission, the Federal Labor Relations Authority, the NG Office of Complex Investigations, the Federal Services Impasses Panel and Federal and State Courts. (10%)
6. Reviews sensitive financial disclosure statements for General Officers and other key personnel. Provides or participates in various training activities, prepares reports, and provides counsel on complex ethics issues and policies; and ensures Federal and state/territory annual administrative reporting requirements are met. (10%)
7. Performs other duties as required.
Requirements
- Must be able to obtain and maintain the appropriate security clearance within 12 months of appointment in the position.
- May be required to successfully complete a probationary / trial period.
- This position is covered by the Domestic Violence Misdemeanor Amendment (30 Sep 96) of the Gun Control Act (Lautenberg Amendment) of 1968. An individual convicted of a qualifying crime of domestic violence may not perform the duties of this position.

- Must possess a valid state driver’s license to operate government motor vehicles, for the state in which they live or are principally employed, in accordance with Army and Air Force Vehicle Operations Directives.
- No record of conviction by civilian courts of offenses listed in the applicable Service Military Justice regulations.
- Must not have any military disciplinary action (Article 15 or Court-Martial) on military records for engaging in an unprofessional or inappropriate relationship as defined in applicable DoD Instructions.
- Must not have any Unfavorable Information Files, civil convictions (other than minor traffic violations), or open Inspector General investigations.
- To maintain the position - The incumbent must have a current Network License according to Army or Air Force Directives, Licensing Network Users and Certifying Network Professionals.
- Work may require frequent travel away from the normal duty station on military and commercial aircraft.
- Must either be currently in good standing (certified) with a State Bar or able to obtain certification. Must be a graduate of an ABA-accredited law school.
- Position is designated as Essential Personnel and may be subject to duty in preparation for, or in response to, a state emergency or disaster declaration.
- This designation will not exceed 14 calendar days per year unless otherwise approved in advance by the TAG.
- Participation in direct deposit is mandatory.
Qualifications
BASIC QUALIFICATION: The following six basic qualification competencies (Knowledge, Skills, Abilities, and Behaviors) are required to successfully meet the basic qualification factors within an applicable career level in the Series GS-0905, Attorney-Adviser program positions:
Skilled in collecting and analyzing data effectively, efficiently, and accurately.

SPECIALIZED EXPERIENCE: Must have at least 24 months work experiences as a professional Attorney Advisor.
Experienced in conducting legal research in connection with cases pending administrative hearings, trials before courts of original jurisdiction, or arguments in appellate courts.
Experienced in addressing legal questions referred by administrative officials of the employing agency, such as questions concerning the interpretation and application of statutes, rules, and regulations as they pertain to contracts, claims, or other legal instruments involving private business, state, local, national, or foreign governments.
Experienced in addressing questions regarding the effects of provisions of proposed legislation or proposed changes in agency policies or regulations.
Experienced in researching and providing legal advice in functional areas of Administrative, Labor, Medical and Physical Disability, and Ethics Law.
Experienced in planning, coordinating, and formulating litigation strategies.
Experienced in addressing complex and difficult legal questions and factual issues requiring extensive research, analysis and evaluation of available precedents.
Experienced in dealing with issues in the functional areas and demonstrated abilities to quickly identify both the legal and judgmental issues. As a subject matter expert, experienced in determining the facts and recommending effective solutions with minimal guidance or supervision.
Experienced in developing and providing solutions to conflicting or contradict-tory DoD regulations, directives, and policies, and other NGB or state 881legal guidance.
Experienced in addressing and resolving complex and difficult legal case problems, legal questions, or issues involved in the drafting of interpretation or application of legislation, regulations, contracts, decisions, or opinions requiring a solution. Experienced in preparing memoranda of reports that outlined and analyzed the factual and legal issues.
Experiences involved preparing legal documents or advisory opinions, participated in contract negations, and examined documents for legal sufficiency.
Experienced in reviewing programs that required analysis of interrelated issues of effectiveness, efficiency, or productivity; and, developed recommendations to resolve issues and problems.

Education
EDUCATION REQUIREMENTS: Attorney-Adviser, it is mandatory to have a Bachelor of Laws or Juris Doctor degree in law issued by an ABA- accredited law school; and must be admitted to practice law in the highest court of any U.S. state, commonwealth, territory or the District of Columbia.
- In addition to the standard education requirements and law degree qualifications, education achievements are allowed as limited substitutions for specialized experience factors in the GS-0905-13, JFHQ Attorney-Adviser position.
- Applicants at a minimum, must have in excess of three years of post-J.D. legal experience, one of which was specialized experience at, or equivalent to, the GS-13 grade level.
