The incumbent serves as the Louis A. Johnson VA Medical Center (LAJVAMC) Equal Employment Opportunity (EEO) Program Manager in Clarksburg, West Virginia, and is aligned under the Director.
Duties
Manages the EEO Programs of the medical center with employees in a wide variety of occupations (professional, administrative, technical, clerical, trades and crafts, etc.). Analyzes and identifies systemic problems as well as individual cases in the EEO areas. Assists the Office of Resolution Management (ORM), staff attorney, and Administrative Judges with investigations and hearings. In collaboration with the ORM Field Office, EEO Manager serves as the local liaison for all aspects of the medical center's complaint process, discussing resolution efforts, negotiating settlements, and drafting same on behalf of the LAJVAMC's Director. EEO Manager provides advice and assistance during the post-investigative states (i.e., hearings, appeals, and compliance phases) for each formal complaint as requested.
Manages the Alternative Dispute Resolution (ADR) Program at the medical center, which is any procedure or combination' of procedures voluntarily used to resolve issues in controversy, without the need to resort to litigation. This includes assisting with settlement negotiations, conciliations, facilitation, mediation, fact- finding and arbitration that require an impartial advisor or neutral third party.
The EEO Manager is a trained mediator and serves as a mediator for VISN 5 and participates in mediation sessions throughout the Network upon request.
This includes assisting parties to:
Structure the negotiation
Clarify the core issues in dispute
Avoid personality conflicts that disrupt the negotiation
Identify the strengths and weaknesses of each person's position
Prepares medical centers annual EEOC MD 715 report and ensure the facility is in compliance with regulations; Investigates and recommends resolution of complex problems to management;
Liaison for the facility Director, VHA Central Office Staff and the Office of Resolution Management
Develops reviews and updates all plans associated with the EEO program that are required by the EEOC, OPM, VHA Central Office, Regional Counsel, and Medical Center Director.
EEO Manager uses original and unprecedented, or only partly precedented, methods of identifying and eliminating barriers to equal employment. EEO Manager is involved with significant impact of findings and recommendations in technical personnel management as well as in the station's budgeting and planning.
EEO Manager writes and updates affirmative action plans on Minorities and Women, Disabled Veterans, Handicapped and Severely Disabled Persons, and assists with development of the Federal Equal Opportunity Recruitment Report (FEORP).
EEO Manager prepares EEO related reports required by the VA Central Office (VACO), the Equal Employment Opportunity Commission, and the Office of Personnel Management, as well as internal reports within the station to keep management thoroughly informed about the EEO Program. EEO Manager prepares and revises written correspondence, memorandums and policies for the Medical Center Director's signature. Takes action to resolve informally, potential EEO problems brought to his or her attention when possible. Serves on temporary and permanent committees established on matters concerning actions at LAJVAMC.
Provides and assists in developing training programs in equal opportunity and supervisory practices for managers and supervisors, and employees at all levels to inform them of the laws, regulations, policies and procedures which affect EEO. Conduct training for all employees as the technical expert on EEO, Alternative Dispute resolution (ADR), Diversity, prevention of workplace harassment including both sexual harassment, bullying and domestic violence.
EEO Manager manages the medical center's Special Emphasis Program (SEP) (Federal
Women's Program, Hispanic Employment, Person With Disabilities, Black History Month, Martin Luther King and Native American/Asian American Programs) ensuring all activities are carried out in accordance with local policy.
EEO Manager ensures the Special Emphasis/ Diversity & Inclusion Committees strive to eliminate imbalances in the targeted occupations, and help achieve a diversity workforce at LAJVAMC. EEO manager works in collaboration with HR on high-level initiatives.

Qualifications
To qualify for this position, applicants must meet all requirements by the closing date of this announcement, 10/13/2023.
Time-In-Grade Requirement: Applicants who are current Federal employees and have held a GS grade any time in the past 52 weeks must also meet time-in-grade requirements by the closing date of this announcement. For a GS-12 position you must have served 52 weeks at the GS-11. The grade may have been in any occupation, but must have been held in the Federal service. An SF-50 that shows your time-in-grade eligibility must be submitted with your application materials. If the most recent SF-50 has an effective date within the past year, it may not clearly demonstrate you possess one-year time-in-grade, as required by the announcement. In this instance, you must provide an additional SF-50 that clearly demonstrates one-year time-in-grade. Note: Time-In-Grade requirements also apply to former Federal employees applying for reinstatement as well as current employees applying for Veterans Employment Opportunities Act of 1998 (VEOA) appointment.
You may qualify based on your experience and/or education as described below:
Specialized Experience: You must have one year of specialized experience equivalent to at least the next lower grade GS-11 in the normal line of progression for the occupation in the organization. Examples of specialized experience would typically include, but are not limited to: knowledge of the principles, concepts, legal requirements, and methodology of the Federal equal employment opportunity program; and skill in applying this knowledge to perform independent assignments for which there are precedents. This includes practical knowledge and skill in interpreting, explaining, and applying a body of law, regulations, and procedures; skill in applying conventional factfinding, analytical, and problem solving methods; knowledge of the common policies, practices, and operations of the Federal personnel system, as well as the structure and functions of Federal agencies, and knowledge and skill to analyze facts, identify problems, report findings, make conclusions, and recommend corrective or other appropriate action.

Physical Requirements: This position is mostly sedentary with work performed in an office setting with heating and air conditioning. Walking, bending, sitting for long periods at a computer, with light lifting of files is expected.
