The Visitor position is under the Guardianship, Protective Proceedings, and Durable Power of Attorney statute, D.C. Code § 21-2033. Appointed by the court in a guardianship or protective proceeding, a Visitor has no personal interest in the proceeding and shall interview an individual who is an alleged incapacitated adult, or subject of the proceeding, as well as the petitioner and any person nominated to serve as guardian or conservator.
Duties
The Visitor will visit the residence or proposed place of residence of the alleged incapacitated adult, and will submit a written report prior to the court hearing to include the Visitor’s investigation of the residence or proposed place of residence, the condition of the alleged incapacitated adult, whether a conflict or potential conflict of interest of the guardian/conservator exists. The Visitor shall nominate a guardian/conservator to the Court. Additional duties include conducting interviews and reviewing records to assess claims of potential financial exploitation, neglect or other issues impinging on the vulnerable adult's well being.
Requirements
- Background and security investigation are required.
- Must petition the court for compensation.
Qualifications
Professionals must be licensed in the District of Columbia.
Education
Training and experience in assessing the type of abilities, limitations, and needs alleged in the petition is required. Training or experience in case management, rehabilitation, financial management, and the planning of care or treatment of causes or conditions leading to the incapacity is preferred.
