The primary purpose of this position, ATTORNEY-ADVISOR (CONTRACT) NH-0905-04, is to serve as a senior legal advisor, providing support for all acquisition activities serviced, including advice on technology transfer and data rights issues. Advises the Program Executive Office (PEO) on all matters except military justice.

Duties

Serve as chief legal counsel for designated Program Executive Office (PEO) acquisition programs. Provide legal advice and assistance to Federal laboratories and Technology Transfer officials on Technology Transfer, services, data rights copyright law, licensing and intellectual property law as assigned. Examine legal issues raised by requests for formal opinions or legal advice. Communicate and coordinate legal advice with other attorneys and the offices of General Counsel at higher levels with the Air Force, as well as other Department of Defense agencies and other agencies of Federal, State and Local Government. Maintain current knowledge of changing statutory and regulatory guidance relating to system development, technology acquisition, technology transfer services, and sustainment, as well as general developments in technology that may improve the effective delivery of legal services.

  • Incumbent is required to obtain and maintain the appropriate security and program clearance necessary to execute the duties of this position.

  • Employee must be a graduate of a law school accredited by the American Bar Association, and be currently licensed as an attorney, in active (or equivalent) status and in good standing, with the bar of a U.S. state, territory, or commonwealth.

  • Work may occasionally require travel away from the normal duty station on military or commercial aircraft. Subject to Temporary Duty Assignment (TDY) approximately 30 days per year.

  • Incumbent must be currently licensed as an attorney and counselor-at-law in a state or territory of the United States, the District of Columbia, or the Commonwealth of Puerto Rico.
  • Incumbent is required to maintain Continuing Legal Education (CLE) currency as established by incumbent's bar.
  • Attorney appointments are subject to serve a one-year probationary period.
  • Candidates are not required to have active duty service or veterans’ preference to be referred and considered. All qualified candidates who meet the recruitment assessment criteria will be referred to the selecting official.

Qualifications

GENERAL REQUIREMENTS: You MUST have successfully completed a full course of study in a school of law accredited by the American Bar Association (ABA) and have the first professional law degree (LLB or JD). Note: You must submit a copy of your transcripts. In addition, at the time of application, you must provide proof, dated within four months of application, of "active" status with a bar of the highest court of a State, U.S. commonwealth, U.S. territory, or the District of Columbia. On-line information is allowed as long as it shows that you are in "active" status. A copy of the Bar Card is not sufficient proof of good standing. Upon admission to the Bar, have you completed one of the following: I meet the basic education requirements and I have, or within 120 days of the closing date of this announcement will have, at least three years of professional legal experience at or equivalent to the GS-13 or equivalent pay band (NH-03) Professional legal experience should include, but is not limited to: expert knowledge of laws, regulations, precedents, and procedures related to labor and employment law and litigation; ability to provide representation in third-party administrative disputes, such as appeals to the Merit Systems Protection Board (MSPB), hearings before the Equal Employment Opportunity Commission (EEOC), labor arbitrations and hearings, Unfair Labor Practice charges before the Federal Labor Relations Authority (FLRA), and in other venues and forums; Skill in case preparation, making strategy decisions responding to and making discovery requests; questioning and cross-examining witnesses; filing briefs and motions; advocating at hearing; and utilizing mediation and settlement strategies; ability to provide expert legal counsel and advice to commanders, directors, other management officials, and the Civilian Personnel Office on all issues arising from the employment of civil service and non-appropriated fund employees. KNOWLEDGE, SKILLS AND ABILITIES (KSAs): Your qualifications will be evaluated on the basis of your level of knowledge, skills, abilities and/or competencies in the following areas: 1. Professional knowledge of federal acquisition law and related legal matters (including but not limited to Systems Acquisition; Research & Development; and Facilities contracting matters and the Fiscal, Taxation, Environmental, Anti-Trust, ethics, various civil law matters and Patents, Copyright, Licensing, and Technical Data Rights aspects thereof). Provide a wide variety of and Technology Transfer services, as assigned, including but not limited to patents, trademarks, copyrights, data rights, licensing, copyright, data rights, technical transfer, and other intellectual property issues. 2. Knowledge, skill and ability of technical transfer and general intellectual property law and practice, including preparation and negotiation of Technology Transfer Agreements, including but not limited to knowledge, skill and ability related to licensing, copyrights, trademarks, trade secret, non-disclosure agreements, cooperative research and development agreements, education partnership agreements, commercial test agreements, nondisclosure agreements, material transfer agreements, computer software use and release agreements, for example. 3. Maintenance of a current license as an attorney and counselor at law in a state or territory of the United States, the District of Columbia, or the Commonwealth of Puerto Rico. 4. Demonstrated skill in researching legal issues raised by requests for formal opinions, the analysis of complex factual situations in light of the results of such legal research and general legal principles, and the preparation of written legal opinions and fraud remedies plans based upon such research and analysis. 5. Proven skill in effectively communicating, both orally and in writing. PART-TIME OR UNPAID EXPERIENCE: Credit will be given for appropriate unpaid and or part-time work. You must clearly identify the duties and responsibilities in each position held and the total number of hours per week. VOLUNTEER WORK EXPERIENCE: Refers to paid and unpaid experience, including volunteer work done through National Service Programs (i.e., Peace Corps, AmeriCorps) and other organizations (e.g., professional; philanthropic; religious; spiritual; community; student and social). Volunteer work helps build critical competencies, knowledge and skills that can provide valuable training and experience that translates directly to paid employment. You will receive credit for all qualifying experience, including volunteer experience. PHYSICAL REQUIREMENTS: The work is primarily sedentary. May require some walking, standing, bending, carrying and/or lifting of light items such as paper or books. No special physical demands are required to perform the work. WORK ENVIRONMENT: The work is performed in a typical office setting, requiring the use of normal safety precautions necessary for an office environment. The work area is adequately lighted, heated and ventilated.

Education


Must be a graduate of a law school accredited by the American Bar Association, and be currently licensed as an attorney, in active (or equivalent) status and in good standing, with the bar of a U.S. state, territory, or commonwealth.
