Requirements

  • Acceptance of an excepted service position constitutes concurrence with these requirements as a condition of employment.
  • Males born after 31 December 1959 must be registered for Selective Service.
  • Federal employment suitability as determined by a background investigation.
  • May be required to successfully complete a probationary period.
  • Continued employment in this position is contingent upon satisfactory completion of the mandatory training specifically identified for the position.
  • Must be able to obtain and maintain the Government Travel Credit Card (GTC) as a condition of employment.
  • Must possess a valid PR State driver’s license to operate government motor vehicle in accordance with Service specific Vehicle Operations Directives.
  • Must be able to obtain and maintain the appropriate SECRET security clearance for the position.
  • Federal employees currently serving in the excepted service (Title 32) must acknowledge they will voluntarily leave the Title 32 excepted service by accepting an offer of employment for this NG Title 5 excepted service position.
  • Irregular and overtime (compensatory) hours may be required to support operational requirements or contingencies.
  • Position designated as Essential Personnel and may be subject to duty in preparation for, or in response to, a state emergency or disaster declaration and will not exceed 14 calendar days per year unless otherwise approved in advance by the TAG.
  • The incumbent of this position must be able to obtain and maintain required education and certifications within specific time from the appointment date, as applicable.

Qualifications

Area 3 = Current serving members of the Puerto Rico Air National Guard. Area 4 = Prior (former) members of the Puerto Rico Air National Guard. Area 5 = Current Federal Employees (from any agency). (All other Areas will be screened only in the event that there are no qualified or recommended Candidates) DUTIES: As a ATTORNEY-ADVISER (GENERAL) (NGT0097000), GS-0905-13, you will serve as the full-time professional legal advisor and support to Sexual Assault Response Coordinator and State Equal Employment Opportunity advisors, and subordinate commanders to support the state prevention efforts relating to sexual assault, sexual harassment, and domestic abuse . This position also serves as a professional legal adviser to the United States Property and Fiscal Officer (USPFO), state/territory National Guard senior leadership, state/territory National Guard directorates, and subordinate National Guard commanded units or state/territory level divisions. Act as a legal adviser and attorney for the most diverse, complex, difficult, and novel legal issues found in the emerging area of victims' right law and will be responsible for the formulation of SIT/DC legal policy and its execution in the areas of sexual assault accountability, prevention, and response; sexual harassment; and domestic abuse for Army and Air personnel. DoD SPARX training is recommended but not required and there is not an annual credentialling requirement. SELECTED FACTOR: 1) You must be graduate with first the professional law degree (Bachelor of Laws or Juris Doctor degree in law issued by an ABA-accredited law school). Note: Copy of official/student transcripts showing conferred Degree must be included in order to receive credit for education. Unofficial transcripts from internet or with alterations will not be considered. 2) You must have Active membership currently in good standing (certified) in the bar of the highest court of a State, U.S. commonwealth, U.S. territory, or the District of Columbia. The Military Departments may also extend the requirement for active bar membership to assignment of civilian attorneys within their respective Departments. Note: Copy of the active membership must be submitted with your application. SPECIALIZED EXPERIENCE: Applicant must possess more than TWO (2) year in the occupational series code 0905 at the next lower level of GS-12 or the equivalent professional legal experience performing or supervising duties such as a a legal adviser and attorney for the National Guard, assisting in the formulation of legal policy pertaining to prevention of sexual assault, sexual harassment, and domestic abuse; advising in military justice/adverse actions that are initiated against alleged offenders; preventing future harm by the proper procedures; advising and providing legal sufficiency reviews of sexual assault and sexual harassment prevention methods; developing definitions for essential primary prevention competencies for leaders; advising on any policy or guidance regarding the removal of restrictive policies on sensitive data collection in order to advance primary prevention of sexual harassment and sexual assault in the military; advises on any legislation, laws, policy, or guidance related to victims' rights or survivor facilitation and healing; ensuring execution is consistent legislative intent, executive orders, current U.S. Codes and state/territory laws, court decisions and agreements; serving as legal counsel and advises on any legislation, policy, or guidance providing for an authorization and funding; advises the convening authorities on procedural and legal issues associated with Courts Martial, Non-Judicial Punishment Administrative Board proceedings and subsequent actions; and reviews Claim Investigating Officer reports, adjudication recommendations, regardless of filing location, and approves forwarding of actions to the appropriate claim's office.
