Duties
The Senior Counsel serves as a legal expert on matters under the jurisdiction of the Division Counsel, Small Business/Self-Employed (SB/SE), acting as an advisor to the Division Counsel, the Deputy Division Counsel, Area Counsel, Deputy Area Counsel or other designated manager.
SB/SE provides legal services on tax matters involving legal issues, regulations and needs relevant to serving individuals filing Schedules C, E, F, and Form 2106, as well as corporations, S corporations, estates, and partnerships with assets less than $10 million dollars. As such, the Senior Counsel must perform a variety of duties that may involve case or project work. This includes complex research, advisory, analysis, and review functions to handle and resolve specific cases or complicated issues. These cases and issues can require decision-making and review/signatory responsibility for final products or outcomes as delegated by the manager; and for program responsibilities in which the Senior Counsel is responsible for assisting in efforts to improve the quality and efficiency of legal practices and services provided by SB/SE.
As a General Attorney (Tax) - Senior Counsel, you will:
Work with IRS personnel on special projects of national impact.
Serve as team leader on large-scale guidance and publication projects that may include representatives from other Divisions or IRS offices. Direct and coordinate work of other team members, and oversee all related administrative and logistical matters in connection with the review of complex advisory opinions, private letter rulings, closing agreements, Chief Counsel Advice, technical advice, revenue rulings, revenue procedures, notices, announcements, briefs, defense letters, affirmative suit letters, settlement letters, and other technical materials for publication, develops procedural guidelines to assist attorneys in the development of work products.
Research complex issues and trends affecting legal services and determines likely legal ramifications on organizational programs. Ensure that the legal or administrative consequences of potential actions are fully considered and write decision papers to determine Office position on these matters. Apply a high level of sophisticated analysis and research to identify and assess approaches to make recommendations on behalf of the Office.
Develop complex cases for trial, utilize sophisticated formal discovery tools, and select and works with expert witnesses; serve as the lead for trial teams assigned to complex cases. Determine the correctness of the legal positions determined in the notice of deficiency or determination; analyze facts, identify relevant, significant issues, and accurately determine applicable tax provisions, and authorities; coordinate legal positions, briefs, pleadings and other documents with the national office, SB/SE headquarters, and other divisions.
Use knowledge of Tax Court Rules and Federal Rules of Civil Procedure related to e-Discovery and e-Litigation to effectively litigate cases in the U.S. Tax Court, including using litigation technology database review tools and trial litigation software; review complex pleadings and set out the Commissioner's legal and procedural position in letters recommending defense of refund, collection and other suits; recommend appropriate motions or jurisdictional defenses.
Recommend the filing of suits, interventions or counterclaims on behalf of the Commissioner; make appeal recommendations where appropriate; coordinate legal positions with the national office, SB/SE headquarters and other divisions; handle bankruptcy work, including referrals, defense letters, and assistance to the Department of Justice; coordinate legal positions with the national office, SB/SE headquarters and other Divisions.

Qualifications

To qualify for this position of General Attorney (Tax) - Senior Counsel, you must meet the qualification requirements listed below by the closing of this announcement:
Basic Requirements for General Attorney (Tax) - Senior Counsel:
Possess at least the first professional law degree (LL.B. or J.D.) from a law school accredited by the American Bar Association; AND
Applicants must be an active member in good standing of the bar of a State, U.S. Commonwealth, U.S. territory, the District of Columbia, or the Commonwealth of Puerto Rico.
GS-15 Experience Requirements:
1 year of general professional legal experience from any area of expertise; plus
3 years of professional legal tax experience
Professional legal tax experience is defined as thorough and comprehensive professional knowledge of and understanding of Federal tax statutes and regulations, and Internal Revenue service policies and decisions, particularly as they relate to tax laws affecting individuals filing schedules C, E, F and/or form 2106 as well as corporations, S-corporation, and partnerships with assets less than $10 million. At least one year of this experience must be equivalent to the work performed at the next lower grade/level position in the federal service (GS-14). Note: Only experience gained after Bar Admission may be credited as Professional Legal Experience.
Education Substitution: An LL.M. degree in the field of the position (tax, GLS-related, or P&A- FOIA/Disclosure related field) may be substituted for the one year of the general legal experience listed above.
Experience refers to paid and unpaid experience, including volunteer work done through National Service programs (e.g., Peace Corps, AmeriCorps) and other organizations (e.g., professional; philanthropic; religious; spiritual; community; student; social). You will receive credit for all qualifying experience, including volunteer experience. One year of experience refers to full-time work; part-time work is considered on a prorated basis. To ensure full credit for your work experience, please indicate dates of employment by month/year, and indicate number of hours worked per week, on your resume.
Time in Grade Requirement for GS-15: Applicants who have held a General Schedule (GS) position within the last 52 weeks must have 52 weeks of Federal service at the next lower grade or equivalent (GS-14).
