This position is located in the Operations and Administration Division, Office of the Chief Counsel. The candidate serves as an Attorney-Advisor managing legal services pertaining to employment law, with an emphasis on litigation before the EEOC, MSPB, U.S. District Courts, and U.S. Courts of Appeals. You will also be responsible for the performance of legal services and coordination of legal activities concerning FHWA’s FOIA and Suspension and Debarment Programs.

Qualifications
To qualify, you must have experience and education equal or equivalent to the following:
GRADE 11 - A law degree (J.D.) and bar membership in good standing.
GRADE 12 - A law degree (LL.B. or J.D.), bar membership in good standing AND you must have at least 2 years of professional legal work experience of a progressively responsible nature.
GRADE 13 - A law degree (LL.B. or J.D.), bar membership in good standing AND you must have at least 3 years professional legal work experience of a progressively responsible nature.GRADE 14 - A law degree (LL.B. or J.D.), bar membership in good standing AND at least 4 years of professional legal work experience of a progressively responsible nature including work in at least one of the following legal practice areas: litigation, employment law, civil rights, FOIA, and/or Suspension & Debarment.
For grades 12 to 14 you can substitute one year of experience with any of the following:
have a second professional law degree (LL.M.) which required 1 full year of graduate study; OR
meet any of the criteria indicated below:
Academic standing in top one-third of law school graduating class;
Graduation with academic honors;
Significant participation on the law school's official law review;
Significant participation on the law school's moot court team;
Full time or continuous participation in a legal aid program;
Served as a summer law office clerk for at least 2 summers full time; or
Other equivalent evidence of clearly superior achievement.
KNOWLEDGE, SKILLS AND ABILITIES (KSAs): Your qualifications will be evaluated on the basis of your level of knowledge, skills, abilities and/or competencies in the following areas:
Civil Litigation – Knowledge of and demonstrated facility with litigation skills, including drafting persuasive legal motions and/or briefs, preparing a correct and complete written record, propounding and responding to discovery requests, taking and defending depositions, negotiating and drafting settlement agreements, developing written and/or oral testimony, arguing motions, appeals, and/or trying cases, applying the Federal Rules of Civil Procedure, and working with witnesses and clients effectively.
Employment Law – Knowledge of and experience providing legal advice or conducting litigation on employment law matters on such as issues involving employment discrimination, employee performance, employee misconduct, whistleblower issues, reasonable accommodation, claims of harassment, and/or merit system issues such as those involving hiring or promotion.
Oral Communication - Expresses information (for example, ideas or facts) to individuals or groups effectively, taking into account the audience and nature of the information (for example, technical, sensitive, controversial); makes clear and convincing oral presentations; listens to others, attends to nonverbal cues, and responds appropriately.
Writing - Recognizes or uses correct English grammar, punctuation, and spelling; communicates information (for example, facts, ideas, or messages) in a succinct and organized manner; produces written information, which may include technical material, that is appropriate for the intended audience.
Experience refers to paid and unpaid experience, including volunteer work done through National Service programs (e.g., Peace Corps, AmeriCorps) and other organizations (e.g., professional; philanthropic; religious; spiritual; community, student, social). Volunteer work helps build critical competencies, knowledge, and skills and can provide valuable training and experience that translates directly to paid employment. Education
MANDATORY EDUCATION REQUIREMENTS: In order to qualify for this position, candidates must have successfully completed a full course of study in a school of law accredited by the American Bar Association (ABA) and have a professional law degree, and must currently be a member in good standing of the bar of a State or Territory of the United States, District of Columbia or Commonwealth of Puerto Rico bar.
