This position is located in the Office of Federal Contract Compliance Programs (OFCCP). The mission of OFCCP is to enforce, for the benefit of job seekers and wage earners, the contractual promise of affirmative action and equal employment opportunity required of those who do business with the Federal government. Open to All OFCCP current employees with competitive status. This position is inside the bargaining unit.

Duties

Evaluations and investigations which the employee leads or conducts typically are characterized by: issues of systemic discrimination or failure to develop or make a good faith effort to implement acceptable affirmative action plans; need to analyze and synthesize voluminous and disparate data into findings of fact; investigative data collection problems of above average difficulty; complicated white collar personnel systems; strong and aggressive union involvement; and complicated collective bargaining agreements. The Specialist: -Independently conducts or leads teams in conducting complex compliance evaluations and compliant investigations. Develops strategies for investigation or data collection and analysis, conciliates issues, negotiates with officials and may use precedents to draft remedies for discriminatory practices and other noncompliance designed to correct the violation(s); -Independently applies principles of 41 CFR 60, the FCCM, and current national and regional office guidance and directives with particular emphasis on Part 60-3 applying theories of discrimination; -Identifies discrimination based on evaluation and investigatory activity. Develops and presents evidence of discrimination meeting applicable standards of proof. Identifies and defines persons and classes affected by discrimination. Applies the appropriate theory of discrimination relevant to the facts, including but not limited to disparate treatment, adverse impact, and reasonable accommodation theories. Calculates monetary losses and fashions remedies designed to remedy identified violations; -Gathers, accurately enters, summarizes, and analyzes high volume of data provided in multiple forms, including electronic; -Negotiates remedies, writes reports, conducts meaningful detailed analysis and evaluates contractor development and implementation of Affirmative Action Programs. Evaluates contractors of varying sizes, industries and complexities; -Provides technical assistance to contractors to assist in their implementation of acceptable affirmative action programs; -Prepares recommendations for enforcement action. This requires analysis and organization of widely varied types of evidence, such as relevant labor statistics, personnel files, policy statements, employment practices data, and results of interviews in such a manner that the completed file is ready for use by an attorney in an administrative or judicial hearing; -Establishes and maintains contacts with minority, women's and veterans' interest groups, community based organizations, job training and development organizations, and trade and business organizations in the labor areas served to exchange information, equal opportunity problems, and the extent of, or resources for improving contractors' compliance with equal employment opportunity regulations and results for workers. Plans, designs, and conducts workshops and training sessions; -Conducts surveys of employment trends with respect to equal employment opportunity in the geographical area served; -Serves as a team leader providing direction and giving feedback to team members; -Maintains continued monitoring of contractors' programs to ensure corrective action is taken and effective nondiscriminatory employment programs are implemented; and -Compiles and drafts accurate, timely, and thorough reports, letters and memoranda. -Provides training and mentorship to less experienced staff.

You must meet the "Specialized Experience" to qualify for Equal Opportunity Specialist, as described below. For GS-12: Applicants must have 52 weeks of specialized experience equivalent to at least the next lower grade level GS-11 in the Federal Service. Specialized Experience is the experience that equipped the applicant with the particular knowledge, skills, and abilities (KSA's) to perform the duties of the position successfully, and that is typically in or related to the position to be filled. To be creditable, specialized experience must have been equivalent to at least the next lower grade level. Qualifying specialized experience for GS-12 includes: - Investigating, analyzing, and evaluating an organization's equal opportunity compliance program in accordance with federal and/or state laws, regulations, and/or policies. - Experience investigating programs that prohibit federal contractors/subcontractors from workplace discrimination. - Experience investigating and adjudicating discrimination complaints related to civil rights violations. - Experience supporting litigation actions relating to resolution of compliance, equal employment opportunity, affirmative action, diversity and/or compliance complaints.
