The Equal Employment Program Manager/Alternative Dispute Resolution Coordinator for VA Texas Valley Coastal Bend Health Care System (VATVCBHCS), Harlingen, Texas will serve as the principal advisor in the area of Equal Employment Opportunity, Affirmative Employment, the Civil Rights External Programs, Diversity Management and ADR-Mediation for VATVCBHCS.

Duties

The EEO Manager/ADR Coordinator is responsible for and reports to the health care system director on EEO program development, administration, evaluation, and advisory functions. The EEO Manager/ADR Coordinator will advise Health Care System senior management on EEO issues/problems, EEO laws, regulations, and policies. Analyze and address workplace conflicts, EEO complaints, and barriers to equal employment opportunity. Meet with managers and/or supervisors in an effort to resolve the problem at this level. Recommends Alternative Dispute Resolution (ADR) and coordinates complaints resolved in ADR with the Health Care System's legal advisor. Obtains signatures of all parties involved in ADR prior to forwarding to the Director for concurrence. Notify the Office of Resolution Management of ADR results. Contacts Health Care System managers and supervisors for information and documents that support management's decisions, actions and/or programs. Forecast and plan workforce changes. Maintain quality customer service. Oversee management of local EEO resources. Assist the Office of Resolution Management in the resolution of EEO complaints. The EEO Manager/ADR Coordinator will direct a program that provides continuing positive equal employment consulting services to managers at all levels, concentrates on systemic equal employment opportunity problems as well as on individual problems, and provides program direction and guidance in the areas of affirmative action (including female and minority recruitment planning) and complaint resolution. The EEO Manager/ADR Coordinator conduct studies and analyzes the utilization of minorities and women in the workplace. Identifies obstacles and outlines alternative solutions to problems identified. Compiles and analyzes statistical data. Identify organizational and/or occupational areas that need improvement. Develop alternatives for resolving barriers and problems. Analyze the workforce by race, sex, grade, and occupational series. Analyze policies and practices that may affect employment opportunities. Schedule meetings and identify training needs of health care system. The EEO Manager/ADR Coordinator analyze programs' data bases, reviews for trends and barriers, and recommends solutions to problems that may adversely affect the Health Care System's Equal Employment programs. Gather data from a variety of sources. Maintain ADR Tracker and CATS reports. Run root cause analysis for EEO complaints to develop strategies for addressing them. Review active complaints from the HCS for trend analysis purposes. Conduct interviews with managers, supervisors and employees to obtain information. Prepare reports of surveys and studies. Recommend actions that prevent or correct negative trends. Brief the Director, executive staff and Health Care System's management on specific actions to support the EEO programs. Develop strategies for handling discrimination complaints. Manage the ADR Program. Identify high volume complaint areas at HCS end review bases/claims of the complaints. Advise the Health Care System's managers and employees about the attributes of mediations. Assign mediators and schedules mediation meetings. Plans, directs, implements, and monitors the Health Care System's Special Emphasis Programs. Recruits and selects program managers. Provides training for managers concerning their responsibilities and their respective program's VA and VISN policies and procedures. Establishes and maintains contacts with the local community groups interested/involved with civil rights and/or equal opportunity. Establish collaborative initiatives with institutions such as Historically Black Colleges and Universities (HBCU), Hispanic Serving Institutions (HIS), and Native American Tribal Colleges (NATO). Develops and updates, implements, coordinates, monitors, and evaluates the EEO Program Status Report (PSR); Federal Employment Opportunity Recruitment Plan (FEORP); and, Disabled Veterans Affirmative Action Plan (DVAAP) for the Health Care System. Work Schedule: 8:00am to 4:30pm Telework: VA supports the use of telework as a way to help attract and retain talented individuals in public service, increase worker productivity, and better prepare the agency to operate during emergencies. Qualifications

To qualify for this position, applicants must meet all requirements by the closing date of this announcement, 07/21/2023. Time-In-Grade Requirement: Applicants who are current Federal employees and have held a GS grade any time in the past 52 weeks must also meet time-in-grade requirements by the closing date of this announcement. For a GS-11 position you must have served 52 weeks at the GS-9. The grade may have been in any occupation, but must have been held in the Federal service. An SF-50 that shows your time-in-grade eligibility must be submitted with your application materials. If the most recent SF-50 has an effective date within the past year, it may not clearly demonstrate you possess one-year time-in-grade, as required by the announcement. In this instance, you must provide an additional SF-50 that clearly demonstrates one-year time-in-grade. Note: Time-In-Grade requirements also apply to former Federal employees applying for reinstatement as well as current employees applying for Veterans Employment Opportunities Act of 1998 (VEOA) appointment. You may qualify based on your experience and/or education as described below: Specialized Experience: You must have one year of specialized experience equivalent to at least the next lower grade GS-9 in the normal line of progression for the occupation in the organization. Examples of specialized experience would typically include, but are not limited to: thorough knowledge and application of federal Equal Employment Opportunity Commission laws and regulations, compliance, executive orders, court decisions, Personnel Management, Federal Personnel Regulations and enforcement skills, as well as VHA Equal Employment Office/Diversity Program guidelines and principles. This includes but is not limited to 29 CFR Part 1614, Title VII of the Civil Rights Act, Title I and Title V of ADA, ADA Amendment Act, Title VI, Prohibited Employment Policies and Practices, and Retaliation and Reprisal/No Fear Act. Knowledge of Title VI and Title IX laws and Regulations and the causes of barriers to Equal Employment opportunities to against protected classes of individuals. Knowledge of the VHA and the Health Care System's organizational structure, management policies, procedures, and practices to plan, direct, implements, and monitor the Health Care System's Special Emphasis Programs; conduct periodic evaluations of the workforce; analyze policies and practices that may affect employment opportunities; identify programs goals; and recommend actions that prevent or correct negative trends. Skill in analytical and evaluative methods and techniques to conduct EEO and Affirmative Employment programs studies and complaint investigations and recommend solutions. Skill in identifying equal employment opportunity problems and developing concrete action plans to solve these problems to advise Health Care System managers on appropriate courses of action to eliminate barriers to equal employment opportunity. Ability to communicate effectively both verbally and in writing, to prepare reports specific to the EEO Program as well brief the Director, leadership staff, managers and employees on aspects of the Equal Employment Office program. To qualify based on education for this grade level you must have Ph.D. or equivalent doctoral degree or 3 full years of progressively higher level graduate education leading to such a degree or LL.M., if related (TRANSCRIPT REQUIRED) OR, Combination: Applicants may also combine education and experience to qualify at this level. You must have an combination of specialized experience and education beyond a Masters degree.
